Bezug: Beschluß der Sondersitzung der Justizminister und -senatoren vom 24. April 1991 in Berlin Siehe auch C180, C183, C184, C185 und C187 Inhalt: Vereinfachung und Straffung von Gerichtsverfahren, insbesondere zur Gewinnung zusätzlicher Ressourcen für den Aufbau der Justiz in den neuen Bundesländern, u.a. Beschränkung des Angebots an Rechtsmitteln: Einführung der Zulassungsberufung in der Zivil-, Straf-, Sozial- und Verwaltungsgerichtsbarkeit, Erhöhung der Berufungssumme bei Zivilgerichten, Einführung der Zulassungsrevision bei Strafgerichten und der reinen Zulassungsrevision bei Zivilgerichten; verstärkter Einsatz des Einzelrichters, Einschränkung der Besetzung der Spruchkörper, Erweiterung der amtsgerichtlichen Zuständigkeit in der Zivilgerichtsbarkeit, Einschränkung des Beweisantragsrechts in der Strafgerichtsbarkeit, Einführung eines Gerichtsbescheids und Erweiterung des Vorverfahrens bei Sozialgerichten; teilweise zeitliche Befristung der Maßnahmen; Änderung und Ergänzung versch. §§ Zivilprozeßordnung und Einführungsgesetz, Strafprozeßordnung, Jugendgerichtsgesetz, Gerichtsverfassungsgesetz, Sozialgerichtsgesetz, Verwaltungsgerichtsordnung, Finanzgerichtsordnung, Bundesgebührenordnung für Rechtsanwälte, Änderung § 29 Deutsches Richtergesetz, Änderung § 32 und Aufhebung der §§ 31 und 33 Asylverfahrensgesetz, Aufhebung Art. 3 § 3 Entlastungsgesetz für Finanzgerichte, Änderung § 19 Anerkennungs- und Vollstreckungsausführungsgesetz, der §§ 3 und 4 Gesetz zur Überleitung der Obersten Rückerstattungsgerichte, des Kostenverzeichnissen zum Gerichtskostengesetz sowie der Anlage I, Kap. III, Sachgeb. A, Abschnitt III Einigungsvertrag (betr. Gerichtsverfassungsgesetz), Aufhebung § 33 Wohngeldgesetz und § 46 Bundesleistungsgesetz. Es entstehen keine Kosten. Änderungen aufgrund der Ausschußempfehlung: Präzisierung beim Einsatz von Einzelrichtern und hinsichtlich des Streitwerts, Ausdehnung der Strafgewalt des Amtsgerichts, Ruhen der Verjährung in bestimmten Fällen ab der Eröffnung des Hauptverfahrens in Strafverfahren, Wegfall versch. Regelungen des Ursprungsentwurfs, u.a. Verzicht auf die Zulassungsberufung in der Zivil- und Verwaltungsgerichtsbarkeit und auf die erleichterte Ablehnung von Beweisanträgen nach Schluß der Beweisaufnahme; Wegfall der Art. 2, 9, 10,11, 12 und 13 der Vorlage, Aufhebung § 4 Rechtspflege- Anpassungsgesetz, Einführung § 78b Strafgesetzbuch, Änderung § 45 Gesetz über das Wohnungseigentum und das Dauerwohnrecht sowie der §§ 220 und 229 Baugesetzbuch.
