<b>Reference:</b> Legislative mandate from Art. 17 of the Unification Treaty, Federal Law Gazette II 1990, No. 35 S. 885 (see GESTA 11. WP C84 <br><br><b>Contents:</b> Rehabilitation and compensation of those most seriously affected by SED injustice (people who were criminally convicted by German courts in the former GDR and committed to psychiatric institutions in violation of the rule of law), compensation and care for people deprived of their freedom by the Soviet occupying power; simplifying and speeding up the procedures for overturning judgments; Compensation and pension scheme: Payment of a basic amount of 300 DM per month of imprisonment to all those convicted in violation of the rule of law, including those who have already received benefits under the Prisoner Assistance Act, taking these payments into account; Payment of a surcharge of 150 DM per month of imprisonment to all victims living in the accession area until November 9, 1989 because of particular disadvantage; Increase of a further amount of 150 DM per month of imprisonment by the Foundation for Former Political Prisoners for those affected in a "particularly impaired economic situation"; Support benefits of 150 DM for affected spouses, parents and children; Care for disabled people in accordance with the Federal Care Act for health damage caused by imprisonment; Survivors' benefits if the person concerned died from injuries caused by imprisonment or the surviving dependents' benefits are not insignificantly reduced as a result of imprisonment; Criminal Rehabilitation Act as Article 1 of the proposal; no further application or change to Article 18 Paragraph 2 and individual provisions in Appendix I Chapter. III Subject Area A Section III of the Unification Treaty as well as Article 4 Nos. 1 and 2 of the agreement of September 18, 1990, repeal of the GDR Rehabilitation Act of September 6, 1990; New version of Section 64b of the Federal Central Register Act, amendment of Sections 9a and 20 of the Prisoner Assistance Act, addition of Section 3 of the Act on the Administrative Procedure for War Victims' Care and Section 3 of the Income Tax Act, amendment of Section 14 of the Housing Benefit Act and Section 16a of the Act on Compensation for Criminal Prosecutions. The costs are borne equally by the federal government and the states. DM 1.55 billion is estimated for the capital compensation, while the pension benefits are expected to initially cost DM 8 million annually.
