Bezug: Der Gesetzesantrag wurde bereits in der 11. WP eingebracht (s. GESTA 11. WP C121, Abschlußband S. 1182) Inhalt: Verbesserung des strafrechtlichen Schutzes ausländischer Mädchen und Frauen vor sexueller Ausbeutung in der Bundesrepublik Deutschland: Ausdehnung der Straftatbestände "Prostitution" und "Menschenhandel" durch Verzicht auf das Tatbestandsmerkmal "Gewerbsmäßigkeit" und Erweiterung der Tatalternativen, Erweiterung der Möglichkeiten zur Abschöpfung von Verbrechensgewinnen durch Einführung der Nebenstrafe "Abschöpfung des Taterlöses"; Einfügung eines § 44a und Änderung der §§ 180a und 181 Strafgesetzbuch sowie Einfügung eines § 459i Strafprozeßordnung. Es entstehen keine Kosten. Änderungen aufgrund der Ausschußempfehlung: Vereinheitlichung des Schutzbereichs und der Merkmale verschiedener Straftatbestände, insbesondere beim Begriff des schweren Menschenhandels, Ablösung generischer Maskulina durch geschlechtsindifferente Formulierungen; Änderung des § 100a Strafprozeßordnung.
