<b>Bezug:</b> Empfehlung des 61. Deutschen Juristentages 1996 zur Abschaffung der Durchgriffserinnerung <br><br><b>Europäische Impulse:</b> Art. 6 EG-Vertrag und andere gemeinschaftsrechtliche Vorgaben, insbesondere des EuGH <br><br><b>Inhalt:</b> Neuregelung des Aufgabenbereichs für Rechtspfleger: Modifizierung von Pflichten betr. Vorlagen an den Richter, Neuordnung der Rechtsbehelfe durch Ersatz der Durchgriffserinnerung durch das nach allgemeinen Vorschriften zulässige Rechtsmittel, Konkretisierung der sachlichen Weisungsfreiheit des Rechtspflegers sowie Streichung der Vorschrift über vorzubereitende Tätigkeit des Rechtspflegers; Änderung versch. §§ Rechtspflegergesetz sowie des § 96 Bundesgebührenordnung für Rechtsanwälte. Es entstehen keine Kosten. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Titeländerung (eingebracht als: Drittes Gesetz zur Änderung des Rechtspflegergesetzes); Ausdrückliche Erwähnung der sachlichen Unabhängigkeit des Rechtspflegers, Anpassung des Kostenrechts an das bevorstehende Inkrafttreten des neuen Insolvenzrechts, Verlängerung der sog. Funktionsrichter-Regelung in den neuen Bundesländern; Änderung der Art. 14, 29, 30 und 31 Einführungsgesetz zur Insolvenzordnung, § 10 Rechtspflege-Anpassungsgesetz, der §§ 110 und 917 Zivilprozeßordnung, § 24 Einführungsgesetz zur Zivilprozeßordnung, § 149 Bundesrechtsanwaltsordnung, § 81 Patentgesetz sowie § 131 Patentanwaltsordnung. <br><br><b>Nebenschlagwörter:</b> Bundesgebührenordnung für Rechtsanwälte/Änderung § 96 BRAGO betr.
