<b>Bezug:</b> Beschlußempfehlung des Innenausschusses (BT Drs 12/5141) zum Schengener Abkommen, BGBl II 1993, Nr. 23 S. 1010 (s. GESTA 12.WP 1- XB03) Der Gesetzentwurf ist textidentisch mit der Regierungsvorlage auf BR Drs 543/98 B114 <br><br><b>Europäische Impulse:</b> Bericht der EU-Kommission zu Art. 2 Abs. 1 Schengener Durchführungsübereinkommen (SDÜ) betr. Grenzkontrollen <br><br><b>Inhalt:</b> Befugniserweiterung des Bundesgrenzschutzes: Identitätsfeststellung einer Person ohne konkrete Verdachtsmomente auch auf Bahnanlagen und während der Zugbegleitung sowie auf allen vom Bundesgrenzschutz betreuten Flughäfen (außerhalb der 30 km-Zone des Grenzgebietes), Durchführung von Personenkontrollen zur Verhütung grenzbezogener Straftaten (§ 12 Abs. 1 Nr. 1 bis 4), keine Berührung der Zuständigkeiten der Polizeien der Länder; Änderung der §§ 23 und 44 Bundesgrenzschutzgesetz sowie redaktionelle Folgeänderungen aus der geänderten Zählweise in § 23 Abs. 1. Den öffentlichen Haushalten entstehen keine Kosten. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Ausschluß flächendeckender Personenkontrollen im Reiseverkehr, Befristung der Kontrollerweiterung des Bundesgrenzschutzes auf fünf Jahre. <br><br><b>Nebenschlagwörter:</b> Personenkontrolle/Personenkontrollen durch den Bundesgrenzschutz auch außerhalb des 30 km-Grenzgebietes * Strafverfolgung/ Personenkontrollen durch den Bundesgrenzschutz zur Verhütung grenzbezogener Straftaten * Bahnanlage/Ausweitung der Personenkontrollen des BGS auf Bahnanlagen und während der Zugbegleitung
