<b>Bezug:</b> Urteil des Bundesverfassungsgerichts vom 3.7.2000 (2 BvG 1/96) zu § 2 Abs. 4 Bundesfernstraßengesetz Siehe auch J014 <br><br><b>Inhalt:</b> Verfassungskonforme Ausgestaltung der Befreiung des Bundes von der Straßenbaulast einer Bundesfernstraße, die nicht mehr dem weiträumigen Verkehr dient (Bau von Ortsumgehungen, Umstufung von Ortsdurchfahrten), verbindliche Regelungen der Abstufung einer Bundesfernstraße in einem Planfeststellungsbeschluss, Zuständigkeit für die Erteilung der Plangenehmigung bei den Obersten Landesstraßenbaubehörden; Änderung §§ 2 und 17 Bundesfernstraßengesetz. Der Bund kann jährliche Kosten von mindestens 3 Mio. DM vermeiden. Ländern und Gemeinden entstehen nicht näher zu beziffernde Unterhaltungskosten. <br><br><b>Änderungen durch das Vermittlungsverfahren:</b> Einziehung von Bundesfernstraßen, die jede Verkehrsbedeutung verloren haben; alternativ unverzügliche Überlassung an den nach Landesrecht zu ermittelnden Träger der Straßenbaulast (Abstufung). <br><br><b>Nebenschlagwörter:</b> Straßenbaulast/Befreiung des Bundes von der Straßenbaulast einer Bundesfernstraße * Planfeststellung/Abstufung einer Bundesfernstraße in einem Planfeststellungsbeschluss
