<b>Bezug:</b> Der Gesetzentwurf ist textidentisch mit dem Entwurf der Fraktionen der SPD und B90/GR auf BT Drs 14/8854 E045 Siehe auch E013 <br><br><b>Europäische Impulse:</b> Ständige Rechtsprechung des EuGH seit der Entscheidung Leclerc von 1985 (EuGH 1985, 1, 35, Rdnr. 26), Entschließungen des EP seit 1981, in Ausarbeitung befindliche Richtlinie des EP und des Rates über die Buchpreisbindung (2001/2061 (INI)) <br><br><b>Inhalt:</b> Gesetzliche Regelung der Preisbindung von Verlagserzeugnissen für Verkäufe innerhalb Deutschlands, Geltung sowohl für den stationären Buchhandel als auch für Fernabsatzgeschäfte, Schutz vor Umgehungsgeschäften, Regelungen für Verleger und Importeure, Ausnahmen (Mängelexemplare, Verkauf an Bibliotheken, Schulbuch- Sammelbestellungen), Dauer der Preisbindung; Gesetz über die Preisbindung für Bücher (Buchpreisbindungsgesetz) als Art. 1 der Vorlage, Änderung § 15 Gesetz gegen Wettbewerbsbeschränkungen (Preisbindung bei Zeitungen und Zeitschriften).
