Summary

<b>Europäische Impulse:</b> Umsetzung von fünf neuen europäischen Richtlinien aus dem April bzw. Juli 2002, u.a. Richtlinie 2002/21/EG über einen gemeinsamen Rechtsrahmen für elektronische Kommunikationsnetze und -dienste (Rahmenrichtlinie) (ABl. EG Nr. L 108, 24.04.2002, S. 33) <br><br><b>Inhalt:</b> Umsetzung europäischen Rechts im Telekommunikationsbereich mit dem Ziel einer technologieneutralen Regulierung aller Kommunikationsmittel und der Vermeidung unnötiger Regulierungen, Übergang ins Wettbewerbsrecht, Herstellung größerer Verwaltungseffizienz und Verkürzung von Gerichtsverfahren, Datenschutzregelungen, Neuregelung der Befugnisse der Regulierungsbehörde für Telekommunikation und Post; Außerkrafttreten des Telekommunikationsgesetzes von 1996 sowie von sechs zugehörigen Verordnungen. Es entstehen keine Kosten. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Klarstellungen und Korrektur redaktioneller Versehen, Einfügung eines Diskriminierungsverbots und einer Transparenzverpflichtung in die Vorschriften zur Zugangsregulierung; Änderung § 100b Strafprozessordnung, §§ 2 und 20 Artikel 10-Gesetz sowie von § 23 Gesetz zur Entschädigung von Zeugen und Sachverständigen (falls das TKG vor dem Justizvergütungs- und -entschädigungsgesetz in Kraft tritt (Art. 1 Kostenrechtsmodernisierungsgesetz)), Aufhebung § 4 Telekommunikations-Datenschutzverordnung. <br><br><b>Änderungen durch das Vermittlungsverfahren:</b> Regelungen zum entbündelten Breitbandzugang, zur missbräuchlichen Ausnutzung einer marktbeherrschenden Stellung und zur Telefonauskunft. <br><br><b>Nebenschlagwörter:</b> Rechtsangleichung in der EU/Umsetzung von EU-Recht im Bereich Telekommunikation * Telekommunikations-Datenschutzverordnung/ Außerkrafttreten der Telekommunikations-Datenschutzverordnung betr.
