<b>Bezug:</b> Entscheidung des Bundesverfassungsgerichts vom 3. März 2004 zur bisherigen Ausgestaltung der präventiven Telekommunikations- und Postüberwachung (1 BvF 3/92) <br><br><b>Europäische Impulse:</b> Leitlinien der Gemeinschaft für staatliche Beihilfen zur Rettung und Umstrukturierung von Unternehmen in Schwierigkeiten <br><br><b>Inhalt:</b> Neuregelung der Überwachungsmaßnahmen zur Straftatenverhütung im Außenwirtschaftsverkehr nach Vorgaben des Bundesverfassungsgerichts; Aufhebung §§ 39 bis 43 und 51 Außenwirtschaftsgesetz, Änderung und Ergänzung versch. §§ Zollfahndungsdienstgesetz, Änderung §§ 1, 2 und 3 Telekommunikations-Überwachungsverordnung sowie von § 100b Strafprozessordnung. Den öffentlichen Haushalten entstehen keine Kosten. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Titeländerung (eingebracht als: Gesetz zur Neuregelung der präventiven Telekommunikations- und Postüberwachung durch das Zollkriminalamt (NTPG)); Betonung der Abwehr großer Gefahren als Gesetzeszweck, insbesondere der Proliferation von Massenvernichtungswaffen, Beschränkung von Überwachungsmaßnahmen bei Berufsgeheimnisträgern, Verschärfung der Voraussetzungen, unter denen eine Benachrichtigung Betroffener unterbleiben kann; Ausdehnung der Einzelnotifizierungspflicht für Investitionsbeihilfen auf mittlere Unternehmen; Wegfall der vorgesehenen Änderung von § 100b Strafprozessordnung, Änderung § 5 Investitionszulagengesetz 2005 sowie von § 6 Investitionszulagengesetz 1999. <br><br><b>Nebenschlagwörter:</b> Zollkriminalamt/Gesetz zur Neuregelung der präventiven Telekommunikation- und Postüberwachung durch das Zollkriminalamt * Überwachung des Fernmeldeverkehrs/Gesetz zur Neuregelung der präventiven Telekommunikation- und Postüberwachung durch das Zollkriminalamt * Außenwirtschaftsgesetz/Aufhebung §§ 39 bis 43 und 51 AWG betr.
