Summary

<b>Bezug:</b> Urteil des Bundesverfassungsgerichts vom 3. März 2004 zur Umsetzung der akustischen Wohnraumüberwachung in der Strafprozessordnung (1 BvR 2378/98, 1 BvR 1084/99) <br><br><b>Inhalt:</b> Umfassende Neuregelung der akustischen Wohnraumüberwachung (§§ 100c bis 100f StPO) nach Vorgaben des Bundesverfassungsgerichts: absoluter Schutz des Kernbereichs privater Lebensgestaltung, Stärkung des Richtervorbehalts, Datenschutzregelung, Benachrichtigungspflichten und Ermöglichung nachträglichen Rechtsschutzes, Regelung für Lichtbilder und Bildaufzeichnungen, Reduzierung des Katalogs der Anlassstraftaten auf besonders schwere Straftatbestände; Änderung §§ 74a und 120 Gerichtsverfassungsgesetz, § 59 IStGH-Gesetz sowie von § 14 Schwarzarbeitsbekämpfungsgesetz. Es können Mehrkosten entstehen, die jedoch nicht bezifferbar sind. <br><br><b>Änderungen aufgrund der Ausschußempfehlung:</b> Aufnahme des Besitzes und der Verbreitung von Kinderpornographie in den Anlasstatenkatalog, Regelung der Löschung von Daten aus der Abhörung von Berufsgeheimnisträgern, Verwendung fehlerhaft erhobener Daten ausnahmsweise auch zur Gefahrenabwehr. <br><br><b>Änderungen durch das Vermittlungsverfahren:</b> Erweiterung des Katalogs der Anlasstaten für akustische Wohnraumüberwachung um die gewerbs- oder bandenmäßige Fälschung von Zahlungskarten, Schecks und Wechseln; Änderung § 129 Strafgesetzbuch. <br><br><b>Nebenschlagwörter:</b> Strafprozessordnung/Änderung §§ 100c bis 100f StPO betr. akustische Wohnraumüberwachung * Gerichtsverfassungsgesetz/Änderung §§ 74a und 120 GVG betr. akustische Wohnraumüberwachung * IStGH-Gesetz/Änderung § 59 IStGHG betr. akustische Wohnraumüberwachung * Schwarzarbeitsbekämpfungsgesetz/Änderung § 14 SchwarzArbG betr. akustische Wohnraumüberwachung * Strafgesetzbuch/Änderung § 129 StGB betr. akustische Wohnraumüberwachung
