Summary

Umsetzung der EU-Richtlinie zum Verfahren der aufsichtsrechtlichen Beurteilung von Erwerb und Erhöhung von Beteiligungen im Finanzsektor, Harmonisierung und Verbesserung des Überprüfungsprozesses von qualifizierten Beteiligungen: Anzeigepflicht, Beurteilung der Zuverlässigkeit des interessierten Erwerbers, Zusammenarbeit der Behörden der Mitgliedstaaten; Änderung von sechs Gesetzen und zwei Rechtsverordnungen Zusätzliche Haushaltsausgaben sind nicht zu erwarten. Beschlussempfehlung des Ausschusses: Herausnahme der Änderungen der Anlagevorschriften für fondsgebundene Lebensversicherungen mit Mindestgarantie, Anzeigepflicht auch für E-Geld-Institute, Klarstellung zur Prüftätigkeit der BaFin Europäische Impulse: Prüfauftrag der Finanzminister der EU vom September 2004 zur Untersuchung möglicher Hindernisse für grenzüberschreitende Fusionen und Übernahmen im Bankensektor; daraus resultierende Richtlinie 2007/44/EG des Europäischen Parlaments und des Rates vom 5. September 2007 zur Änderung der Richtlinie 92/49/EWG des Rates sowie der Richtlinien 2002/83/EG, 2004/39/EG, 2005/68/EG und 2006/48/EG in Bezug auf Verfahrensregeln und Bewertungskriterien für die aufsichtsrechtliche Beurteilung des Erwerbs und der Erhöhung von Beteiligungen im Finanzsektor (ABl.
