Summary

Weiterentwicklung des bewährten Güterrechtes zur Beseitigung von hervorgetretenen Gerechtigkeitsdefiziten im Falle des Zugewinnausgleichs: Berücksichtigung von bei Eheschließung bestehenden Schulden und Stärkung von Auskunftsrechten, Vorverlegung des Berechnungszeitpunktes sowie Verbesserung des vorläufigen Rechtsschutzes gegen unredliche Vermögensverschiebungen, Integration des Kernanliegens der vorkonstitutionellen Hausratsverordnung in das BGB; Aufhebung der Genehmigungspflicht für Kontoverfügungen von Vormündern, Pflegern und Betreuern oberhalb einer Beitragsgrenze; Änderung zahlreicher §§ sowie Aufhebung §§ 1370 bis 1389 und Einfügung §§ 1568a bis 1568b Bürgerliches Gesetzbuch, Aufhebung Hausratsverordnung, Einfügung § 18 Einführungsgesetz zum Bürgerlichen Gesetzbuche, Änderung § 78a Bundesnotarordnung und § 10 Vorsorgeregister-Verordnung sowie Folgeänderungen in 5 weiteren Gesetzen Den öffentlichen Haushalten entstehen keine Kosten. Beschlussempfehlung des Ausschusses: Änderungen zur weiteren Verbesserung des Schutzes vor illoyalen Vermögensverschiebungen, Vereinheitlichungen betr. geänderte Wortwahl; Klarstellung der Reichweite einer beglaubigten Vorsorgevollmacht in Grundbuchsachen; Erneute Änderung §§ 1375, 1378 und 1379 sowie Änderung § 1568a Bürgerliches Gesetzbuch und zusätzliche Änderung § 6 Betreuungsbehördengesetz sowie erneute Folgeänderungen in 4 weiteren Gesetzen Bezug: Siehe auch C056 und C154
