Summary

Einstellung der Schutzbestimmungen für gewerbliche Muster und Modelle nach dem Haager Musterabkommen in seinen verschiedenen Fassungen in das Geschmacksmustergesetz: Regelungen für die Bereiche Einreichung und Weiterleitung internationaler Eintragungen, Wirkung, Prüfung auf Schutzhindernisse, Erklärung der Schutzverweigerung sowie Möglichkeiten der Schutzentziehung; Änderung § 26 und Einfügung §§ 66 (neu) bis 71 (neu) bei Umsetzung §§ 66 (alt) bis 73 (alt) Geschmacksmustergesetz und Änderung §§ 5 und 6 sowie Anlage (Gebührenverzeichnis) Patentkostengesetz Der erhöhte Vollzugsaufwand beim Deutschen Patent- und Markenamt wird durch neue Gebührentatbestände aufgefangen. Beschlussempfehlung des Ausschusses: Klarstellung betr. Reihenfolge der Verfahrensschritte bei der Prüfung auf Eintragungshindernisse, Regelung von Einzelheiten durch Rechtsverordnung; Erneute Änderung § 26 und Änderung § 69 Geschmacksmustergesetz; Verordnungsermächtigung Bezug: Ratifikation der Genfer Akte zum Haager Musterabkommen, siehe XC014
