Summary

Schaffung der verfassungsrechtlichen Voraussetzungen für die deutsche Beteiligung an der Herstellung eines Einheitlichen Europäischen Luftraumes: Zuordnung der Luftverkehrsverwaltung als Hoheitsaufgabe allgemein zur Bundesverwaltung, Öffnungsklausel für entgegenstehendes EU-Recht betr. Zulässigkeit mittelbarer Bundesverwaltung und Beleihung Privater; Möglichkeit einer Ausgliederung von Unterstützungsdiensten der Flugsicherung aus der Hoheitsverwaltung des Bundes; Änderung Art. 87d Grundgesetz Den öffentlichen Haushalten entstehen keine Kosten. Beschlussempfehlung des Ausschusses: Streichung des EU-Rechtsvorbehaltes wegen dessen unstreitigen Anwendungsvorranges; Änderung Art. 87d Grundgesetz Bezug: Der Gesetzentwurf ist identisch mit dem Entwurf der Fraktionen der CDU/CSU und der SPD auf BT-Drs 16/12280 B100 Gesetz zur Änderung luftverkehrsrechtlicher Vorschriften, s.
