Summary

Maßnahmen zur kurzfristigen Bereinigung der Bilanzen von Finanzholding-Gesellschaften oder Kreditinstituten von risikobehafteten strukturierten Wertpapieren: Möglichkeit der Übertragung an Zweckgesellschaften ("Bad Banks") mit Abschlag vom Buchwert gegen vom Finanzmarktstabilisierungsfonds garantierte Anleihen; Änderung §§ 3a, 4, 9 und 10 sowie Einfügung §§ 6a bis 6d Finanzmarktstabilisierungsfondsgesetz Es entstehen keine zusätzlichen Kosten. Beschlussempfehlung des Ausschusses: Sicherstellung klaren Bilanzabgangs, größere Flexibilität beim Abschlag, steuerrechtliche Sonderregelungen, Besserstellung und Haftungsbegrenzung für Sparkassen, Haftungsregelungen für Alteigentümer zur Minimierung unkalkulierbarer Haushaltsrisiken u. a.; Folgeänderungen und Klarstellungen Bezug: Notwendigkeit der Fortentwicklung der bisher geschaffenen Rahmenbedingungen zur Finanzmarktstabilisierung Siehe auch D083, D097 und D101 Der Gesetzentwurf ist textidentisch mit der Regierungsvorlage auf BR-Drs 442/09 D112
