Summary

Grundlegende Neuregelung des Kontopfändungsschutzes: Neben dem bisherigen Schutzinstrument Einführung eines sog. Pfändungsschutzkonto, hierauf einheitlicher Pfändungsschutz bis mindestens zur Höhe eines automatisch pfändungsfreien monatlichen Sockelbetrages zur Sicherung des Lebensunterhaltes, weitere pfändungsfreie Eingänge, Ausweitung auf Einkünfte nicht abhängig Beschäftigter, Entlastung für Kreditinstitute und Vollstreckungsgerichte, nachrangiges Weitergelten des bisherigen Kontopfändungsschutzes, weitere Einzelanpassungen; Änderung §§ 788, 835, 840, 850i, 850l (neu) und Einfügung §§ 833a, 850k ZPO, Änderung §§ 36 Insolvenzordnung, 314 und 316 Abgabenordnung und 55 SGB I sowie zwei weiterer Gesetze Die Haushalte der Kommunen werden entlastet durch die Befreiung von unbaren Transferleistungsauszahlungen. Bezug: Vierter Bericht der Bundesregierung zur Umsetzung der Empfehlung des Zentralen Kreditausschusses zum Girokonto für jedermann vom 14. Juli 2006, BT-Drs 16/2265 Beschlussempfehlung des Ausschusses: Zur deutlichen Vereinfachung des Kontopfändungsschutzes Verzicht auf ein Nebeneinander zweier Vollstreckungsschutzinstitute durch Abschaffung des bisherigen Kontopfändungsschutzes zum 1. Januar 2012 und Ausbau des Pfändungsschutzkontos zum alleinigen Schutzinstrument, Verfahrensvereinfachungen, Maßnahmen gegen Missbrauch, Eigenständigkeit des Verrechnungsverbotes für Sozialleistungen; Befugnis zur Offenbarung von Steuerdaten im Zuge von Zwangsversteigerungen wegen Hausgeldforderungen oder Wohngeldforderungen; Erneute bzw. zusätzliche Änderung der 6 Gesetze sowie zusätzliche Änderung von 5 weiteren Gesetzen
