Summary

Erweiterung des Selbstbestimmungsrechtes des Erblassers durch Änderungen insbesondere im Pflichtteilsrecht, u.a. betr. Modernisierungen im Bereich Entziehung des Pflichtteils (&bdquo;Enterbung“), 10jährige Ausschlussfrist für Schenkungen, Stundung des Pflichtteils sowie Anerkennung und Ausgleich überobligatorischer Pflegeleistungen durch weiter gefasste Ausgleichspflichten, Vereinfachungen u.a. bei Beschränkungen und Beschwerungen sowie sprachliche und rechtliche Aktualisierung des Erbrechtes des Staates, weitestmögliche Anpassung der bisherigen familienrechtlichen und erbrechtlichen Sonderverjährung an die dreijährige Regelverjährung; Änderung zahlreicher §§ und Einfügung § 2057b sowie Aufhebung §§ 2334 und 2335 BGB und Einfügung § 17 in Art. 229 Einführungsgesetz zum Bürgerlichen Gesetzbuch Den öffentlichen Haushalten entstehen keine Kosten. Beschlussempfehlung des Ausschusses: Wegfall der Berücksichtigung überobligatorischer Pflegeleistungen sämtlicher gesetzlicher Erben bei Verbesserung der bestehenden Anrechnungsregelungen für Abkömmlinge sowie Wegfall nachträglicher Ausgleichung von Zuwendungen, Detailanpassung im Bereich Verjährungsfristen; Erneute Änderung §§ 1836e, 2057a, Verzicht auf Änderung §§ 2050, 2053 und 2315, Verzicht auf Einfügung 2057b sowie Folgeänderungen versch. §§ Bürgerliches Gesetzbuch Bezug: Entscheidung des Bundesverfassungsgerichtes vom 19. April 2005 zu Fragen des Pflichtteilsrechts (BVerfGE 112, 663 ff.)
