Ausgabenbegrenzung betr. Prozesskostenhilfe und Beratungshilfe bei Sicherstellung eines gleichen einkommensunabhängigen Zugangs zum Recht für alle: bei Prozesskostenhilfe Änderungen in den Bereichen Aufklärung und Bewilligungsverfahren, Freibeträge, Ratenzahlung und Ratenberechnung, Anwaltsbeiordnung bei Scheidungen und bei Arbeitsgerichtsverfahren, Kostenhilfe in Markenrechtssachen; bei Beratungshilfe Änderungen in den Bereichen Bewilligungsvoraussetzungen, Erinnerungsrecht der Staatskasse, Strukturierung von Verfahrensabläufen, Flexibilisierung des Vergütungssystems sowie Ausweitung auf steuerrechtliche Angelegenheiten;<br /> Einfügung § 120a sowie Änderung versch. §§ Zivilprozessordnung, Einfügung §§ 6 und 8a, Neufassung §§ 7 und 8 sowie Änderung versch. §§ Beratungshilfegesetz, Änderung und Einfügung versch. §§ in weiteren 14 Gesetzen sowie Folgeänderungen in 3 Gesetzen<br /> <br /> Bezug:<strong> </strong>Gesetzentwürfe des Bundesrates, GESTA C011 und C022<br /> Vereinbarung im Koalitionsvertrag zur Reform des Prozesskostenhilferechts<br /> Entscheidung des Bundesverfassungsgerichts zur Einbeziehung steuerlicher Angelegenheiten in die Beratungshilfe (BVerfGE 122, 39); Entscheidung des Bundesgerichtshofs zur Bewilligung von Verfahrenskostenhilfe (GRUR 2009, 88)<br /> <br /> <strong>Beschlussempfehlung des Ausschusses:</strong> bei der Prozesskostenhilfe (PKH) Verzicht auf Absenkung der Freibeträge für Selbständige und Ehegatten/Lebenspartner, auf Anhebung der Ratenhöchstzahldauer sowie auf erweiterte Auskunftsmöglichkeiten; Änderungen in den Bereichen Zuständigkeit für Bedürftigkeitsprüfungen und nachträgliche Änderung einer PKH-Bewilligung; bei der Beratungshilfe Verzicht auf erweiterte Auskunftsmöglichkeiten sowie auf das Erinnerungsrecht der Staatskasse, Änderungen betr. nachträgliche Antragstellung; weitere Detailanpassungen sowie redaktionelle Änderungen;<br /> Änderung § 120 sowie erneute Änderung versch. §§ Zivilprozessordnung, Änderung §§ 6a, 7 und 13 sowie erneute Änderung einzelner §§ Beratungshilfegesetz, erneute Änderung versch. §§ und Verzicht auf Änderung einzelner §§ in weiteren 11 Gesetzen
