Summary
Umsetzung der verfassungsgerichtlichen Vorgaben ohne Schaffung neuer Befugnisse: Klarstellungen betr. Voraussetzungen für Auskunftsverlangen und Datenabruf in Bundeszuständigkeit von durch Telekommunikationsanbieter gespeicherten Daten, Konkretisierung der berechtigten Behörden in den jeweiligen Fachgesetzen, Rechtsgrundlage für die Zuordnung von dynamischen Internetprotokoll-Adressen, Regelungen für den Zugriff auf Zugangssicherungscodes; Einschränkung von Grundrechten betr. Fernmeldegeheimnis<br /> Neufassung § 113 sowie Änderung §§ 115 und 149 Telekommunikationsgesetz und Einfügung § 100j Strafprozessordnung sowie Änderung, Einfügung und Aufhebung versch. §§ in weiteren 6 Fachgesetzen <br /> <br /> Bezug: Entscheidung des Bundesverfassungsgerichtes vom 24. Januar 2012 über die Verfassungsmäßigkeit der §§ 111 bis 113 Telekommunikationsgesetz (1 BvR 1299/05)<br /> <br /> <span style="font-weight: bold">Beschlussempfehlung des Ausschusses:</span> Einführung von Benachrichtigungspflichten und Richtervorbehalt betr. manuelles Auskunftsverfahren, Klarstellungen zu den zu übermittelnden Daten, Berichterstattung zum 31. Dezember 1915 über die technischen Entwicklungen bei Internet-Protokoll Version 6 (IPv6) und Cloud Computing betr. Ermittlungsmöglichkeiten und Grundrechtsschutzrelevanz;<br /> Änderung § 113 und erneute Änderung § 149 Telekommunikationsgesetz sowie Änderung § 100j Strafprozessordnung, erneute Änderung einzelner §§ in weiteren 6 Fachgesetzen
