Summary

Neuregelung der Betreuungszuständigkeit auf dem Gebiete der Grundsicherung für Arbeitsuchende: Zusammenwirken von Bund und Ländern bzw. Gemeinden in gemeinsamen Einrichtungen als sog. Mischverwaltung zur Aufrechterhaltung der Betreuung und Leistungserbringung aus einer Hand auch über den 31. Dezember 2010 hinaus sowie alleinige Aufgabenwahrnehmung durch eine begrenzte Anzahl von Gemeinden auf Antrag als zugelassene kommunale Träger (Optionskommunen) unter Kostenübernahme des Bundes; Einfügung Art. 91e Grundgesetz Die Kostenwirkung für die öffentlichen Haushalte hängt von der einfachgesetzlichen Ausgestaltung ab. Bezug: Entscheidung des Bundesverfassungsgerichtes vom 20. Dezember 2007 über die Zulässigkeit von Arbeitsgemeinschaften gemäß § 44b SGB II (2 BvR 2433/04 und 2 BvR 2434/04) Der Gesetzentwurf ist textidentisch mit dem Entwurf der Fraktionen der CDU/CSU, der SPD und der FDP auf BT-Drs 17/1554 B018 Gesetz zur Weiterentwicklung der Organisation der Grundsicherung für Arbeitsuchende, s.
