Gesetz zur Fortentwicklung des Meldewesens (MeldFortG)

Summary

Ausfüllung der neuen Gesetzgebungskompetenz durch Zusammenführung des Melderechtsrahmengesetzes mit den Landesmeldegesetzen ohne signifikante Rechtsänderungen zur Herstellung von Rechtseinheit und Sicherstellung eines effektiveren und effizienteren Vollzuges des Melderechts: Daten und Datenspeicherung, Schutzrechte, Meldepflichten, Datenübermittlung zwischen öffentlichen Stellen, Melderegisterauskünfte, Zeugenschutz, Ordnungswidrigkeiten;<br /> <span style="font-weight: bold">Bundesmeldegesetz</span> (BMG) als Art. 1 der Vorlage, Folgeänderung in 10 Gesetzen und 5 Rechtsverordnungen, Verordnungsermächtigung, Aufhebung Melderechtsrahmengesetz<br /> <br /> Bezug: Überführung des Meldewesens in die ausschließliche Gesetzgebung des Bundes durch die Föderalismusreform I<br /> <br /> <span style="font-weight: bold">Beschlussempfehlung des Ausschusses:</span> Umstellung bei Meldeauskünften zu Zwecken der Werbung und des Adresshandels auf Widerspruchslösung und Ausnahmeregelung betr. Aktualisierung bereits vorhandener Daten; Klarstellungen und Änderungen in den Bereichen Datenspeicherung, Auskunftsanspruch Betroffener, allgemeine Meldepflichten, darunter Ausnahmen für Zeitsoldaten und Berufssoldaten, Gebührenfreiheit für Datenübermittlungen und automatisierter Datenabruf, Auskunftsanspruch von Suchdiensten sowie Bußgeldvorschriften;<br /> Änderungen zahlr. §§ Bundesmeldegesetz sowie erneute und zusätzliche Folgeänderungen in weiteren 3 Gesetzen<br /> <br /> <span style="font-weight: bold;">Beschlussempfehlung des Vermittlungsausschusses:</span> Rückumstellung bei Meldeauskünften zu Zwecken der Werbung und des Adresshandels auf Notwendigkeit einer generellen Einwilligung und erneute Ausweitung der Zweckbindung der Auskunft, Löschungsgebot und Wiederverwendungsgebot zur Unterbindung von sog. Adressspooling und Schattenregistern, Bußgeldvorschriften; Verlängerung der Meldepflicht für Soldaten und Polizisten bei Bezug von Gemeinschaftsunterkünften auf 12 Monate; Evaluation der Regelungen betr. Werbung und Adresshandel, Berichterstattung vier Jahre nach Inkrafttreten;<br /> Änderung § 9 sowie erneute Änderung §§ 27, 44, 47, 54 und 56 sowie Einfügung § 58 Bundesmeldegesetz; Verordnungsermächtigung
