Summary
Einführung einer alters- und stichtagsunabhängigen Bleiberechtsregelung zur Aufenthaltsgewährung bei nachhaltiger Integration; Neuordnung des Ausweisungsrechts entlang der Abwägung zwischen privatem Bleibe- und öffentlichem Ausweisungsinteresse (Bekämpfung von Kriminalität, Extremismus und Terrorismus), Überwachung aus Gründen der inneren Sicherheit; Rechtsänderungen zur beschleunigten Durchsetzung aufenthaltsrechtlicher Entscheidungen bei vollziehbar ausreisepflichtigen Ausländern (betr. Identitätsklärung, Fluchtgefahr, Ausreisegewahrsam u.a.); Anpassung der Regelungen zum Einreise- und Aufenthaltsverbot an die Rechtsprechung, Verstetigung des Programms zur Neuansiedlung von Schutzsuchenden (Resettlement-Programm), Verbesserungen für Opfer des Menschenhandels;<br /> Änderung und Einfügung zahlreicher §§ Aufenthaltsgesetz, Änderung §§ 154b, 456a und 458 Strafprozessordnung, Aufhebung Artikel 6 Absatz 2 Gesetz zur Umsetzung der Hochqualifizierten-Richtlinie der Europäischen Union, Änderung § 4a Freizügigkeitsgesetz/EU sowie Änderung zahlreicher §§ Beschäftigungsverordnung<br /> <br /> <strong>Beschlussempfehlung des Ausschusses:</strong> Klarstellung der Regelung zur Fluchtgefahr bzgl. des Anhaltspunkts der Aufwendung erheblicher Geldbeträge für Schleuser, der Sperrwirkung des Einreise- und Aufenthaltsverbots, der Verteilungs- und Zuweisungsregelungen für Resettlement-Flüchtlinge sowie der Begründung eines Bleibeinteresses durch Stellung eines Asylantrags; Härtefallklausel für den Sprachnachweis beim Ehegattennachzug, Erweiterung des Vorgehens gegen Hassprediger, Berufsausbildung als Duldungsgrund für Jugendliche, Bezug von BAföG-Leistungen, Vorrang der Aufenthaltsbeendigung vor Strafverfolgung, Zuständigkeit des Bundesamtes für Migration und Flüchtlinge bei Befristung des Einreise- und Aufenthaltsverbots, Möglichkeit zulassungsfreier Rechtsbeschwerde zum BGH;<br /> Erneute und zusätzliche Änderung versch. §§ Aufenthaltsgesetz, Freizügigkeitsgesetz/EU, Staatsangehörigkeitsgesetz, Bundesausbildungsförderungsgesetz sowie Gesetz über das Verfahren in Familiensachen und in den Angelegenheiten der freiwilligen Gerichtsbarkeit
