Verfassungskonforme Verschonung betrieblichen Vermögens bei Übertragung durch Erbschaft oder Schenkung unter Erhalt der erleichterten Unternehmensnachfolge zur Beschäftigungssicherung und Bewahrung der ausgewogenen Unternehmenslandschaft: Anpassungen bei Regelungen zur Abgrenzung des begünstigten vom nicht begünstigten Vermögen, Freistellung von Kleinstbetrieben von den Lohnsummenregelungen, Verschonungsbedarfsprüfung und Abschmelzmodell als Wahlrecht für den Erwerb großer Betriebsvermögen;<br /> Änderung und Einfügung versch. §§ Erbschaftsteuer- und Schenkungsteuergesetz<br /> <br /> Bezug: Beschluss des Bundesverfassungsgerichts vom 17. Dezember 2014 (1 BvL 21/12)<br /> <br /> <strong>Beschlussempfehlung des Ausschusses:</strong> Zahlreiche Änderungen insbes. betr. Freistellung von der Lohnsummenregelung, besondere Steuerbefreiung bei begünstigungsfähigem Vermögen mit gesellschaftsvertraglichen Beschränkungen, Erhalt der Abgrenzung des begünstigten vom nicht begünstigten Vermögen über einen aktualisierten Verwaltungsvermögenskatalog, Investitionsklausel, Verschonungsabschlag, Stundungsanspruch, Unternehmenswertberechnung nach vereinfachtem Ertragswertverfahren; Ausschluss missbräuchlicher Gestaltungen, redaktionelle und Folgeänderungen;<br /> Änderung §§ 203 und 205 Bewertungsgesetz<br /> <br /> <strong>Beschlussempfehlung des Vermittlungsausschusses:</strong> Grundlegende Überarbeitung, insbes. betr. Verhinderung der Verschiebung von Privatvermögen in das Erbschaftsteuerprivileg durch Cash-Gesellschaften u.a., siebenjährige Ratenzahlung statt zehnjähriger Stundungsmöglichkeit der Steuerschuld, Einschränkung von Verschonungsregelungen für Familienunternehmen u.a., Anhebung des Unternehmenswerts im vereinfachten Ertragswertverfahren bei ständiger Überprüfung durch das BMF und Nichtanwendung bei offensichtlich unzutreffenden Ergebnissen
