Summary
Schaffung von Rechtssicherheit zur Stärkung der Verbreitung von offenen WLAN-Internetzugängen (Hotspots): Präzisierung der Haftung von WLAN-Betreibern für Rechtsverletzungen Ihrer Nutzer, insbes. Ausschluss der Haftung als sogen. Störer bei Beachtung bestimmter Sorgfaltspflichten; Ausschluss des Haftungsprivilegs für Hostprovider mit im Wesentlichen auf der Verletzung von Urheberrechten aufbauenden Geschäftsmodellen; Beseitigung einer Rechtsunsicherheit zur Umsetzung der EU-Richtlinie über audiovisuelle Mediendienste;<br /> Änderung §§ 2, 2a, 8 und 10 Telemediengesetz<br /> <br /> Bezug: Richtlinie 2010/13/EU vom 10. März 2010 zur Koordinierung bestimmter Rechts- und Verwaltungsvorschriften der Mitgliedstaaten über die Bereitstellung audiovisueller Mediendienste (Richtlinie über audiovisuelle Mediendienste) (ABl. L95, 15.04.2010, S. 1)<br /> <br /> <strong>Beschlussempfehlung des Ausschusses:</strong> Streichung von Voraussetzungen und Prüfpflichten für den Haftungsausschluss von WLAN-Anbietern sowie der Regelungen zur Bekämpfung von illegalen Inhalten bzw. Urheberrechtsverletzungen im Internet; Annahme einer Entschließung: Maßnahmen auf europäischer und nationaler Ebene betr. Rechtsdurchsetzung im Internet, u.a. bei Urheberrechtsverletzungen, Behinderung der Finanzierung einschl. Werbeeinnahmen und Verbotsmöglichkeit von Plattformen mit illegalen Inhalten, Entwicklung attraktiver, nutzerfreundlicher legaler Angebote, verbesserte internationale Zusammenarbeit, Datenerhebung zu Persönlichkeitsrechtsverletzungen im Internet, Vorlage der Ergebnisse und ggf. eines Gesetzentwurfs bei festgestelltem Rechtsetzungsbedarf;<br /> Verzicht auf Änderung § 10 Telemediengesetz
