Summary

Umsetzung der novellierten Abfallrahmenrichtlinie als Teil des "EU-Legislativpaketes zur Kreislaufwirtschaft" und einzelner Regelungen der Einwegkunststoff-Richtlinie sowie umweltpolitische Fortentwicklung des deutschen Abfallrechts zur besseren Kreislauferschließung und Ressourcenschonung; zahlreiche Einzelmaßnahmen betr. Vermeidung und Verwertung von Abfällen durch Wiederverwertungs- und Recyclingquoten u.a., Getrenntsammlungspflichten und Ausbau der Produktverantwortung sowie Neuregelung der öffentlichen Beschaffung; Änderung und Einfügung versch. §§ sowie Einfügung Anlage 5 Kreislaufwirtschaftsgesetz, Änderung §§ 18 und 19 Elektro- und Elektronikgerätegesetz, Folgeänderungen in einem weiteren Gesetz und 4 Rechtsverordnungen; Verordnungsermächtigung Bezug: Richtlinie 2008/98/EG vom 19. Mai 2018 zur Änderung der Richtlinie 2000/53/EG über Altfahrzeuge, der Richtlinie 2006/66/EG über Batterien und Akkumulatoren sowie Altbatterien und Altakkumulatoren sowie der Richtlinie 2012/19/EU über Elektro- und Elektronik-Altgeräte (ABl. L 150, 14.06.2018, S. 93) ; Richtlinie 2019/904/EU vom 5. Juni 2019 über die Verringerung der Auswirkungen bestimmter Kunststoffprodukte auf die Umwelt (ABl. L 155. 12.06.2019, S. 1) Beschlussempfehlungen des Ausschusses: Klarstellungen und Änderungen betr. Anzeigeverfahren für gewerbliche Sammlungen und Ansprüche des öffentlich-rechtlichen Entsorgungsträgers, freiwillige Rücknahme von Abfällen, Freistellung der Hersteller oder Vertreiber von Nachweis- und Erlaubnispflichten, Abfallwirtschaftspläne für große Abfallströme, EU-Recyclingquoten, Definition von Mehrwegverpackungen und Verbundverpackungen, Anforderungen an Herstellung und Zusammensetzung u.a.; Annahme einer Entschließung: ausgewogene Berücksichtigung der Belastung von Unternehmen durch Berichtspflichten und angemessener Information über die Vernichtung von Waren in der Transparenzverordnung, Ausnahme für kleine Unternehmen, zunächst betroffene Branchen, Datenerfassung in aggregierter Form, Evaluierung; Annahme einer weiteren Entschließung betr. Evaluation und Prüfung verstärkten Recyclateinsatzes in der Produktion einschl. rechtlicher Anforderungen; Änderung §§ 1, 3, 4 und 16 Verpackungsgesetz sowie Einfügung § 16f Chemikaliengesetz
