Summary
Schutz des Rechts auf geschlechtliche Selbstbestimmung von Kindern mit Varianten der Geschlechtsentwicklung und vor unnötigen Behandlungen an den inneren und äußeren Geschlechtsmerkmalen: Verbot zielgerichteter geschlechtsangleichender Behandlungen von noch nicht einwilligungsfähigen Kindern, Einwilligung der Eltern nur in unaufschiebbaren Fällen bis zur selbstbestimmten Entscheidung des Kindes, Regelungen zur familiengerichtlichen Genehmigung (Kindeswohlmaßstab) unter Vorlage einer befürwortenden Stellungnahme einer interdisziplinären Kommission, Regelung zum vereinfachten Verfahren, Ausnahme von der Genehmigungspflicht zur Abwehr einer Lebens- oder Gesundheitsgefahr, Verlängerung der Aufbewahrungsfrist der Patientenakten, Gesetzesevaluation 10 Jahre nach Inkrafttreten, Vorlage eines Berichts;<br /> Einfügung § 1631e Bürgerliches Gesetzbuch, Änderung Artikel 229 Einführungsgesetz zum Bürgerlichen Gesetzbuche, Einfügung § 167b Gesetz über das Verfahren in Familiensachen und in den Angelegenheiten der freiwilligen Gerichtsbarkeit, Änderung § 14 Rechtspflegergesetz sowie § 45 Gesetz über Gerichtskosten in Familiensachen<br /> <br /> Bezug: Vereinbarung im Koalitionsvertrag zu geschlechtsangleichenden medizinischen Eingriffen an Kindern<br /> <br /> <strong>Beschlussempfehlung des Ausschusses: </strong>Klarstellung betr. Vorgaben für die Zusammensetzung der interdisziplinären Kommission und für die schriftliche Stellungnahme: Aufklärung und Beratung des Kindes durch die Kommission und durch eine Beratungsperson mit einer Variante der Geschlechtsentwicklung (Peer-Beratung), Meinungsbildung und Willensbekundung des Kindes; Verkürzung der Evaluierungsfrist auf 5 Jahre mit Prüfung der Erweiterung der Regelungen bezgl. Umfang des Anwendungsbereichs, Feststellung der Einwilligungsfähigkeit des Kindes, Pflicht zur unabhängigen Beratung sowie Kostenregelung für die Stellungnahme der interdisziplinären Kommission;<br /> Erneute Änderung § 1631e Bürgerliches Gesetzbuch
