Summary
Umsetzung der Vorgaben des Bundesverfassungsgerichts hinsichtlich der Übermittlung nachrichtendienstlich gewonnener Informationen an andere Behörden durch eine normenklare Fassung der Vorschriften für den Bundesnachrichtendienst und Entkopplung der Regelungen vom Bundesverfassungsschutzgesetz durch Auflösung der im geltenden Recht bestehenden Verweisungen; Ausdifferenzierung der Übermittlungsvorschriften nach Art der Empfängerbehörde (Nachrichtendienste, Strafverfolgungsbehörden, andere öffentliche und nichtöffentliche Stellen; Inland/Ausland); Zugrundelegung eines Regel-Ausnahmekatalogs bei der Übermittlung von Daten an öffentliche Stellen mit auch operativen Anschlussbefugnissen (Vorliegen einer konkretisierten Gefahr für ein besonders gewichtiges Rechtsgut als Regel); Anpassung der Übermittlungsregelungen für die strategische Fernmeldeaufklärung; Regelung der Befugnisse des BND zur Sicherung von Verschlusssachen als Maßnahme der Eigensicherung (Personenkontrollen, Durchsuchungen, Auswertung von Geräten u.ä.);<br /> <br /> Bezug: Entscheidung des Bundesverfassungsgerichtes vom 28.
