Summary
Stärkung von Reallaboren als wichtigem Instrument der Innovationsförderung und des regulatorischen Lernens: Begriffsdefinitionen von Reallaboren, Experimentierklauseln und regulatorischem Lernen, Schaffung eines Reallabore-Innovationsportals des Bundes als zentraler Stelle für Beratung, Information, Vernetzung und Wissenstransfer im Rahmen eines höchstens vierjährigen Pilotbetriebs, Regelungen zur Genehmigung, Befristung sowie Verlängerung von Reallaboren, Prüfung der Erfahrungen und Erkenntnisse zur Weiterentwicklung des betr. Rechtsrahmens und der Zulassung der erprobten Technologien, Produkte, Dienstleistungen oder Ansätze, Bericht des BMWE alle drei Jahre;<br /> Gesetz zur Verbesserung der Rahmenbedingungen für die Erprobung von Innovationen in Reallaboren und zur Förderung des regulatorischen Lernens (<strong>Reallabore-Gesetz </strong>– ReallaboreG) als Artikel 1 der Vorlage, Vorratsbeschluss betr. Wegfall von Berichtspflichten und Befristungen nach 48 Monaten als Artikel 2 der Vorlage<br /> <br /> Bezug: Vereinbarung im Koalitionsvertrag zur Stärkung von Experimentierklauseln<br /> Der Gesetzentwurf ist textidentisch mit der Regierungsvorlage auf BT-Drs 21/517 bei rechtsförmlicher Abweichung zu BR-Drs 222/25 GESTA E002<br /> Wiedervorlage des Gesetzentwurfs auf BT-Drs 20/14198 (GESTA 20. WP E065) in geringfügig geänderter Fassung<br /> <br /> <strong>Beschlussempfehlung des Ausschusses:</strong> Titeländerung (eingebracht als: Gesetz zur Verbesserung der Rahmenbedingungen für die Erprobung von Innovationen in Reallaboren und zur Förderung des regulatorischen Lernens); Einführung einer allgemeinen Erprobungsklausel für befristete Ausnahmen oder Abweichungen von verwaltungsrechtlichen Regelungen des Bundes auf Antrag einer Bundes- oder Landesbehörde, Stärkung des regulatorischen Lernens durch Überprüfung der erprobten Verfahren oder Innovationen innerhalb von 6 Monaten, Verbesserung des Wissenstransfers durch Festlegung klarer Strukturen für die Sammlung und Weitergabe von Erkenntnissen in und um Reallabore, Einführung bereichsspezifischer Experimentierklauseln, u.a. betr. Praxisverwaltungssysteme, Europäische Brieftasche für die Digitale Identität, Freiwillige Selbstkontrolle im Bereich des Jugendschutzes, Register über Unternehmensbasisdaten (Basisregister) und Betrieb von Telekommunikationsnetzen, Streichung des befristeten Pilotbetriebs eines Reallabore-Innovationsportals;<br /> Erneute Änderung und zusätzliche Einfügung versch. §§ Reallabore-Gesetz sowie Änderung des Langtitels, des Kurztitels und der amtlichen Abkürzung in Gesetz zur Förderung der Erprobung von Innovationen und neuer Verwaltungsverfahren in Reallaboren und zur Förderung des regulatorischen Lernens (<strong>Bundeserprobungsgesetz </strong>– BErpG), zusätzliche Änderung und Einfügung versch. §§ in 6 Gesetzen; Verordnungsermächtigung
