Summary
Eelnõuga tehakse perehüvitiste seaduses kolm muudatust. Esiteks täpsustatakse vanemahüvitise arvutamise korda, et taastada senine rakenduspraktika pärast Riigikohtu põhiseaduslikkuse kolleegiumi vastavat määrust ning tagada, et ema vanemahüvitise ja jagatava vanemahüvitise suurust saab jätkuvalt arvutada seaduses ette nähtud erinevatel alustel. Teiseks reguleeritakse selgemalt riigile üleläinud elatisnõuete aegumist, et need ei aeguks enne, kui riigil tekib tegelik võimalus nõue võlgnikult sisse nõuda. Kolmandaks parandatakse toitjakaotustoetuse üleminekusättes tehniline viiteviga. Muudatuste eesmärk on suurendada õigusselgust, kõrvaldada tõlgendamisprobleemid ning tagada seaduse korrektne rakendamine.
