Summary
Looduskaitseseaduse muutmise seaduse eelnõu muudab seaduse võõrliike käsitlevaid sätteid. Rakendatakse Euroopa Liidu õigusest tulenevaid reegleid, et vältida looduslikku tasakaalu ohustavate liikide sissetoomist. Keskkonnaamet määratakse Eestis asutuseks, kellel on õigus välja anda lubasid võõrliikide pidamiseks, aretamiseks või kasutamiseks, samuti impordiks, nende vedamiseks ja transiidiks. Keskkonnaamet tegeleb sarnaste ülesannetega ka praegu. Eelnõu näeb ette suurendada võõrliikide kasutamisnõuete rikkumise eest juriidiliste isikute trahvimäära 32 tuhande euroni. Käesoleval ajal kehtib kümme korda väiksem trahvimäär 3200 eurot. Seletuskirjas märgitakse, et see on ebaproportsionaalselt väike võrreldes füüsilistele isikutele ette nähtud maksimummääraga ning liiga leebe karistus rikkumiste eest, mis loodust negatiivselt mõjutavad. Eelnõu kaotab seadusest tähtaja kaitsekordade kooskõlla viimiseks kehtiva looduskaitseseadusega. Praeguse korra kohaselt muutuksid vastavalt seadusele 1. maist 2016 kehtetuks kõik kehtiva looduskaitseseaduse eel kehtestatud kaitse-eeskirjad. Vananenud kaitse-eeskirjadega kaitsealasid on Eestis 190. Tähtaja kaotamisel saab nende kaitsekordi uuendada ilma ajalise surveta.
