Summary
Valitsuse 11. jaanuaril algatatud lennundusseaduse muutmise seaduse eelnõuga (161 SE) tõstetakse lennuohutuse taset ning ühtlustatakse siseriiklik õigus Euroopa Liidu õigusaktidega. Euroopa Liidu tasandil reguleerib tsiviillennunduses toimunud lennuohutust mõjutavatest juhtumitest teatamist EL-i vastav määrus. Selle EL-i määruse jõustumine eeldab muudatuste ja täpsustuste tegemist lennundusseadusesse. Kehtestatakse vajalikud nõuded, et tagada kõigil tasanditel tõhus lennuohutust mõjutavatest juhtumitest teatamise süsteem. Nimetatakse pädevad asutused, keda tuleb teavitada lennuohutust mõjutavatest juhtumitest. Nendeks asutusteks on jätkuvalt Lennuamet ja Ohutusjuurdluse Keskus. Täpsustatakse riigisiseste pädevate asutuste teavitamise ning vastavate andmete edastamise korda. Eelnõu muudab lennuohutust mõjutavast juhtumist teatamise tähtaega. Kehtiva seaduse kohaselt tuleb sellisest juhtumist teatada 24 tunni jooksul, eelnõu kohaselt 72 tunni jooksul. Võrreldes kehtiva teatamise süsteemiga kohustab määrus juhtumist teatajat esitama ka ühe kuu jooksul pärast juhtumi toimumist Lennuametile esialgse analüüsi ning kolme kuu jooksul lõpparuande, mis tooks välja ohutusriskid ja kirjeldaks selle järel rakendatavaid meetmeid.
