Summary
Eelnõuga muudetakse jäätmete liigiti kogumise, laiendatud tootjavastutuse, jäätmetekke vältimise, kohaliku omavalitsuse üksuste ja riigi jäätmekavade ning jäätmete ringlussevõtu tõhustamisega seotud nõudeid ja meetmeid, et saavutada paremad tulemused jäätmete korduskasutamise ettevalmistamises ja ringlussevõtus. Samuti täpsustatakse vastutussätete sõnastusi ja karistusmäärasid. Hiljemalt 31. detsembriks 2023 tuleb kõikjal korraldada biojäätmete tekkekohalt kogumine või alternatiivina tekkekohal kompostimine. Alates 2025. aastast peavad kohaliku omavalitused (KOV) korraldama oma territooriumil tekstiilijäätmete liigiti kogumise. Edaspidi on KOVi territooriumil võimalik teha erandeid jäätmete liigiti kogumisest vaid teatud tingimustele vastavuse korral ning need erandid koos põhjendustega seab KOV jäätmekavas ja jäätmehoolduseeskirjas. Aastaks 2030 tuleb vähendada olmejäätmete ladestamist vähemalt 10 protsendini tekitatud olmejäätmete üldkogusest. Lisaks kehtestatakse uued sihtarvud olmejäätmete korduskasutamiseks ettevalmistamisele ja ringlussevõtule ning pakendijäätmete ringlussevõtule. Alates 2025. aastast tuleb olmejäätmeid korduskasutuseks ette valmistada või ringlusse võtta vähemalt 55 protsenti, viie aasta pärast juba 60 protsenti ning 2035. aastaks peab olema ringlussevõtt suurenenud 65 protsendini. Eelnõuga peab pakendijäätmete ringlussevõtt jõudma 2025. aastaks 65 protsendini ning 2030. aastaks 70 protsendini. Lisaks kehtestatakse ringlussevõtu sihtarvud pakendimaterjalidele liikide kaupa. Täpsustuvad ka laiendatud tootjavastutusega seotud kohustused. Näiteks tõstetakse pakendiaruande audiitorkontrolli kohustuslikku piirmäära, et suunata ressurssi just nendele pakendiettevõtjatele, kes lasevad turule suurema osa pakendimassist, ning vähendada väikeste pakendiettevõtjate ressursikulu. Seni pidid audiitorkontrolli läbima ettevõtted, kes lasevad turule pakendeid üle 5 tonni aastas, kuid edaspidi on piirmäär 20 tonni aastas. Need pakendiettevõtjad, kelle pakendiarvestus on korras, peavad edaspidi läbima audiitorkontrolli alles kolme aasta tagant. Probleemtoodete tootjate ja tootjate ühenduste puhul võib audiitorkontrolli nõuda vajaduse korral Keskkonnainspektsioon. Täpsustatakse vastutussätete sõnastusi ja tõstetakse maksimaalseid võimalikke karistusmäärasid juriidilistele isikutele. Senise 32 000 euro asemel on edaspidi maksimaalne karistusmäär 400 000 eurot. Eelnõuga võetakse üle ja täidetakse ELi vastavatest direktiividest tulenevad kohustused.
