Summary
Eelnõu eesmärk on võimaldada üleminekut digitaalsele asjaajamiskorrale (samuti kohtumenetlustele) ning laiendada vanglas kinni peetavate isikute võimalusi taasühiskonnastavateks tegevusteks: interneti kasutamise võimaluste laiendamine, mobiiltelefoni kasutamise võimaldamine avavangla kinnipeetavatele, samuti lühiajalise väljasõidu ajaks mobiiltelefoni kasutamise võimaldamine, lühiajaliste kokkusaamiste laiem võimaldamine, sh telesilla vahendusel. Selliseid õigusi ja kohustusi reguleerivad sätted on püsinud suuresti muutumatuna, kuid arvestades ühiskonna arengut, on otstarbekas liikuda vastavalt võimalustele üle digitaalsele asjaajamisele ka vanglas ning avardada kinnipeetavate võimalusi tehnoloogia kasutamiseks. Kõnesolevate digilahenduste kasutamise võimaldamiseks antakse vanglatele õigus käidelda vajalikus mahus (ja nende eelneval nõusolekul) kinnipeetavate isikuandmeid. Eelnõuga vähendatakse seaduses sätestatud maksimaalse kartserikaristuse pikkust, et viia VangS-i sätted kooskõlla rahvusvaheliste soovitustega, nähakse ette sissenõudmisele kuuluvate nõuete kinnipidamine vahistatu isikuarvele kantava raha arvelt ja muudetakse kriminaalhooldusaluse joobe tuvastamise dokument otsetäidetavaks, et vähendada tarbetut töökoormust. Kriminaalhooldusseaduse muudatused hõlbustavad ekspertiisikulude sissenõudmist kriminaalhooldusaluselt, kaotades vajaduse tarbetu tsiviilkohtumenetluse järele, milles üksnes kinnitatakse joobe tuvastamise dokumendi olemasolu ning kohustatakse isikut ekspertiisikulud hüvitama. Karistusseadustiku muudatus muudab karistatavaks kinnipidamiskohas aine ja eseme ebaseadusliku üleandmise katse. Täitemenetluse seaduse muudatus seondub rahaliste vahendite kinnipidamistega vahistatute isikuarvelt.
