Summary
Konventsiooni ja protokolliga luuakse ohtlike ja kahjulike ainete mereveol tekkinud merereostuskahjude hüvitamiseks rahvusvaheline süsteem. Eesti plaanib sellega ühineda. Konventsioon ei ole veel rahvusvaheliselt jõustunud ning protokolliga ühinemine tähendab ühtlasi konventsiooniga ühinemist. Konventsioon kohustab osalisriigis registreeritud laeva registreeritud omanikku võtma piisava kindlustuse või muu finantstagatise, et katta kehtivate määrade kohaselt ohtlike või kahjulike ainete tekitatav võimalik reostuskahju. Samuti asutatakse konventsiooniga fond (HNS-fond), mille eesmärk on ohtlikke ja kahjulikke aineid vedava laeva registreeritud omaniku kindlustuse piirmäärasid ületava kahju hüvitamine. Kahju hüvitamise vahendid kujunevad HNS-fondi sissemaksetest. Konventsioonis sätestatud kahjulikke ja ohtlikke aineid meritsi vastu võtvatele ettevõtetele lisandub aruandluskohustus ja fondi sellekohase assamblee otsuse ning fondi esitatud arve alusel fondi sissemaksete tegemine. Sissemakseid HNS-fondi teevad isikud, kes riigis eelmise kalendriaasta jooksul maksustatavat lasti vastu võtsid. HNS-konventsioon kohustab laevaomanikku omama kindlustust või täiendavat rahalist tagatist ning seda kinnitavat tunnistust. HNS-konventsiooniga ühinemine on kavas enamikul Euroopa Liidu riikidel, kuid riikidel on raskusi HNS-ide kohta aruandluse tagamisega.
