Summary
Eelnõuga tehakse muudatused täitemenetluse lõpetamise regulatsioonis ja sellega seonduvalt ka teistes seadustes, et lihtsustada täitemenetluse lõpetamist tsiviilnõudes. Eelnõuga tehakse järgmised olulisemad muudatused: kohtutäituril tekib võimalus tsiviilnõudes täitemenetlus täitmise aegumise korral lõpetada; avaldus täitemenetluse lõpetamiseks täitmise aegumise tõttu vaadatakse kohtus edaspidi läbi hagita menetluses; kohtutäiturile sätestatakse õigus nõuda menetluse lõpetamise korral menetluse põhitasu 50 protsendi ulatuses ja nähakse ette uus tasu aegumisest tuleneva täitemenetluse lõpetamise avalduse läbivaatamise eest; 2021. aasta jaoks sätestatakse kohtutäiturile pikem võlgniku avalduse läbivaatamise aeg; täpsustatakse täitedokumendist tuleneva nõude täitmise aegumise katkemise ja peatumise aluseid.
