Summary
Eelnõuga kehtestatakse raamistik taastuvenergia kasutuselevõtu kiirendamiseks. Täpsemalt sätestatakse Eesti õiguses Euroopa Liidu vastavast määrusest tulenev võimalus ülekaaluka avaliku huviga taastuvenergia projektide kiirendatud rajamiseks. Määratakse kriteeriumid, missugustel tingimustel saab ära jätta keskkonnamõju hindamist. Ühtlasi luuakse taastuvenergia projektidele leevenduse ja loodusväärtuste hüvitusmeetmete süsteem. Ülekaaluka avaliku huviga taastuvenergia projektideks loetakse riikliku energia- ja kliimakavaga 2030 määratud energiaallikate projektid, näiteks tuuleenergia, päikeseenergia, soojuspumpade ja biometaani tootmise projektid. Nimetatud projektide puhul on võimalik teha erandeid loodusdirektiivist, linnudirektiivist ja veepoliitika raamdirektiivist. Ülekaalukas avalik huvi on rakendatav ainult projektide planeerimise käigus ja tegevusloamenetluses. Ülekaaluka avaliku huviga taastuvenergia projekt peab asuma väljapool NATURA 2000 võrgustikku ega tohi kahjustada kaitsealuseid liike. Euroopa Komisjoni algatatud rikkumismenetluse lahendamiseks täpsustatakse seaduses keskkonnamõju hindamise programmi ja aruande avalikustamise teate sisu.
