Summary
Eelnõuga denonsseeritakse Eesti ja Venemaa vaheline leping õigusabi ja õigussuhete kohta tsiviil-, perekonna- ja kriminaalasjades, mis jõustus 1995. aastal. Õigusabilepingu kohaselt tuleb lepingu ülesütlemisest teatada teisele lepingupoolele ette vähemalt kuus kuud enne lepingu viieaastase kehtivusperioodi lõppemist. Seletuskirjas märgitakse, et Venemaa Föderatsiooni agressioonisõda Ukrainas on rahvusvahelise õiguse, seal hulgas ÜRO põhikirja põhimõtete oluline rikkumine. ÜRO põhikirja järgi peavad kõik ÜRO liikmed oma rahvusvahelistes suhetes hoiduma jõu kasutamisest iga riigi territoriaalse puutumatuse ja poliitilise sõltumatuse vastu. Alates 24. veebruarist 2022 on Venemaa pannud Ukrainas toime raskeid sõjakuritegusid, inimõiguste ja rahvusvahelise humanitaarõiguse rikkumisi. Venemaa on 16. maist 2022 välja arvatud Euroopa Nõukogust ning sellega seonduvalt ei kohaldu enam inimõiguste ja põhivabaduste kaitse konventsioon. Nii kaua kui kestab Venemaa täiemahuline agressioonisõda Ukrainas, jätkab Eesti jõupingutusi agressori isoleerimiseks rahvusvahelisel areenil ning säilitab kahepoolsed suhted Venemaaga üksnes absoluutselt vajalikul miinimumtasemel. Õigusabilepingu eelduseks on usaldus teise riigi õigussüsteemide vastu ning kuna usaldus Venemaa õigussüsteemi vastu puudub, lõpetab Eesti õigusabilepingu kehtivuse. Õigusabilepingu kehtetuks tunnistamisega saab Venemaast kolmas riik, kellega Eestil ei ole õigusküsimuste lahendamisel erirežiimi ning tsiviilasjade küsimuses lähtutakse edaspidi rahvusvahelise eraõiguse reeglitest. Õigusabilepingu denonsseerimine ei välista Eesti ja Venemaa edasist koostööd ka kriminaalasjades, kuna ka seal on jätkuvalt võimalik tugineda erinevatele rahvusvahelistele konventsioonidele juhul, kui mõlemad riigid on selle osalised.
