Summary
Eelnõuga kaotatakse kuld- ja hõbetoodete valmistajatele, sissevedajatele ja müüjatele tänapäeval ebamõistlikuks muutunud piirangud. Väärismetalltoodete valmistajad ja sissevedajad peavad kandma tootele oma nimemärgise, mis tuleb registreerida riiklikus nimemärgise registris. Eelnõuga võimaldatakse nimemärgise andmete elektroonilist esitamist ning selle registreeringu kehtivust pikendatakse ühelt aastalt kümnele. Samuti kaotatakse füüsiliste näidiste esitamise nõue. Vähendatakse ka müügidokumendil esitatavate andmete mahtu, näiteks toote massi esitamine pole enam kohustuslik. Eelnõuga tunnistatakse kehtetuks väärismetalltoodete jaemüügi piirangud. Seletuskirjas märgitakse, et praegu ei tohi näiteks väärismetallist kellasid ja kuldehteid müüa tänavakaubanduses, turul, koduuksemüügil, avalikul üritusel ega kioskis, edaspidi on see lubatud. Praegune keeld end praktikas enam ei õigusta, kuna võrreldes 20. aasta taguse ajaga on tarbijakaitseõigus edasi arenenud ja kehtestatud on mh ebaausate kauplemisvõtete regulatsioon, mis kaitseb tarbija ostutehinguid laiemalt. Nimemärgise tasumise riigilõivu suurendatakse 20-lt 30-le eurole ja 2004. aastast pärinevat sunniraha määra 640-lt 9600 eurole. Nimemärgiste registreerimine viiakse AS Metrosertist TTJAsse, kus on parem tehniline võimekus ja ka sisuline pädevus. Tehakse tehnilisi muudatusi ka seadme ohutuse seaduses, kus edaspidi peab ettevõtja seadmetöö majandustegevusteate esitamisel juurde lisama ka kompetentse isiku kinnituse, kus isik kinnitab, et on teadlik oma seotusest ettevõtjaga ja vastutab ettevõttes seadmetöö tegemise eest.
