Summary
Eelnõu näeb ette võimalused teha tööd ka pikaajalisel haiguslehel olles. Töötajal nähakse ette uus võimalus pärast kahekuulist (60 päeva) haiguslehel olemist töötada haiguslehe alusel vastavalt tervisele kohandatud tingimustes, näiteks osalise tööajaga või kergemaid ülesandeid täites. Tervisekassa maksaks samal ajal töötasu vähenemist kompenseerivat hüvitist maksimaalselt 122 päeva, tuberkuloosi korral 180 päeva. Lisaks saab töötaja samal perioodil vajadusel Eesti Töötukassalt töövõimet toetavaid tööturuteenuseid, nt tööalane rehabilitatsioon, kogemusnõustamine, tugiisikuga töötamine, tööks vajalikud abivahendid. Kavandatud muudatus puudutab aastas keskmiselt 17 000 üle 60 päeva kestva ajutise töövõimetusega töötajat, kellest hinnanguliselt 5000 inimest kasutaks haiguslehe ajal töötamise võimalust ja ligikaudu 1800 vajaks selleks toetavaid teenuseid. Lisaks antakse eelnõuga lapsevanemale õigus saada kuni 60 kalendripäeva hooldushüvitist olenemata lapse diagnoosist. Kehtiva korra kohaselt saab 60 päeva hooldushüvitist vaid onkoloogilise diagnoosiga laste põetamisel, kui haigusjuhtum algas haiglas. Mõju tervisekassa eelarvele hooldushüvitise pikendamisel 14 päevalt 60 päevale on keskmiselt 615 000 eurot aastas, mille vajadusega on tervisekassa eelarves arvestatud. Alates 1. maist 2025. a nähakse ette ka uus täiendava ravimi- ja meditsiiniseadmehüvitise regulatsioon. Muudatus vähendab suurte ravimi- ja meditsiiniseadmekuludega inimeste omaosaluskoormust. Hüvitise määramisel arvestatakse kokku patsiendi omaosaluse kulud nii ravimite kui meditsiiniseadmete ostmisel. Kehtiva korra kohaselt arvestatakse täiendavat ravimihüvitist kalendriaastas ravimite ostmisel tasutud summast, mis ületab 100 eurot. Alammäär 100 eurot jääb samaks, kuid kokku arvutatakse nii ravimite kui meditsiiniseadmete kulud. Muudatus võimaldab eelkõige toetada neid patsiente, kelle kõrge omaosalus kujuneb ravimite kõrval just meditsiiniseadmete soetamise kuludest. Eelnõu kohaselt muudetakse ka sotsiaalmaksuseadust ja laiendatakse sotsiaalmaksusoodustust kõikidele ajutise töövõimetuse hüvitistele, kui tööandja soovib kompenseerida vabatahtlikult töötajale haigus- või hoolduslehe ajal saamata jääva töötasu. Praegu on tööandja jaoks sotsiaalmaksuvaba haigushüvitis, mida ta maksab töötajale teise kuni kaheksanda haiguspäeva eest. Samuti võetakse eelnõuga alates 5. aprillist 2024. a töötervishoiu ja tööohutuse seadusesse üle direktiiv, mis näeb ette, et töötervishoiu ja tööohutuse nõuded, mida varem tuli järgida kantserogeenide ja mutageenide puhul, kehtivad edaspidi ka reproduktiivtoksiliste ainetega tööalase kokkupuute korral. Seetõttu tekib tööandjal kohustus korraldada töötajale tervisekontrolli enne reproduktiivtoksiliste ainetega kokkupuute algust.
