Summary
Investeeringute soodustamise ja kaitse lepingud käsitlevad valdkondi, mis on reguleeritud Euroopa Liidu õigusega – eelkõige puudutavad need asutamisvabadust ning kapitali ja maksete vaba liikumist. Seega reguleerib liikmesriikide investeeringute kaitset ja investorite võrdset kohtlemist Euroopa Liidu õigus ning liikmesriikide kahepoolsetel lepingutel puudub sisuline mõte. Küll aga võib nende lepingute puhul tekkida vastuolu Euroopa Liidu õigusega siis, kui vaidluse lahendamisel vahekohtus kerkivad olulised Euroopa Liidu õiguse tõlgendamise küsimused, mida peaks kolmandas riigis asuva vahekohtu asemel lahendama hoopis Euroopa Kohus. Euroopa Komisjon on selle vastuolu välistamiseks pidanud vajalikuks liikmesriikide omavaheliste lepingute lõpetamist ning ka viie liikmesriigi vastu rikkumismenetluse alustanud. Lepingut tuleb enne selle lõpetamist muuta, kuna selle sätete järgi kehtib leping selle jõusoleku ajal tehtud investeeringute suhtes veel kümme aastat pärast lepingu lõpetamist. Leping muudetakse nii, et selle lõpetamisel lõpeks täielikult ka lepingu kohaldamine. Eesti ja Taani vahelise investeeringute kaitse lepingu lõpetamine on vajalik selleks, et tagada Euroopa Liidu õigusaktidest tulenevalt kõikide EL liikmesriikide investorite võrdne kohtlemine. Varem on Eesti lõpetanud kahepoolsed investeeringute soodustamise ja vastastikuse kaitse lepingud Itaalia ning Tšehhiga. Euroopa Liidu liikmesriikidest on Eestil analoogsed lepingud sõlmitud Austria, Hispaania, Hollandi, Kreeka, Leedu, Läti, Poola, Prantsusmaa, Rootsi, Saksamaa, Soome, Ühendkuningriigi ja Taaniga. Juhtivkomisjoniks määrati väliskomisjon.
