Summary
Muudatustega võetakse Eesti õigusesse üle Euroopa Liidu liikluskindlustuse direktiivi muudatused, mille ülevõtmistähtaeg oli 23.12.2023. Eesti suhtes algatas Euroopa Komisjon tänavu 24. jaanuaril rikkumismenetluse direktiivi mitteõigeaegse ülevõtmise eest. Direktiiv ei too kaas suuri muudatusi, kuna liikluskindlustuse süsteem on nii Eestis kui Euroopas laiemalt hästi toiminud. Kindlustuse põhiolemus jääb samaks: esmalt kaitseb see kannatanut, kes sattus õnnetusse ja kes liikluskindlustuselt saab hüvitise. Teisalt ka süüdlast ennast, kelle eest kindlustusandja kannatanule kahju hüvitab. Seaduse jõustumisel hakata liikluskindlustusega katma ka osasid kergliikureid, muu hulgas näiteks elektritõukerattaid, mille kiirus ulatub üle 25 kilomeetri tunnis või üle 14 kilomeetri tunnis, kui sõiduk kaalub üle 25 kilo. Selleks et lihtsamini aru saada, kas sõidukile laieneb kohustuslik liikluskindlustus või mitte, plaanib Eesti Liikluskindlustuse Fond teha veebi vastava abimaterjali. Kui kindlustusselts läheb pankroti, näeb direktiiv ette, et igas liikmesriigis peab olema garantiifond, kes sellisel juhul tema eest kahjud hüvitab. Eestis saab selleks Eesti Liikluskindlustuse Fond, kes kogub maksejõuetuse katteks vahendeid kindlustusseltsidelt. Seaduse muutmisega tõstetakse ka maksimaalselt hüvitatavate kindlustussummade piirmäärasid: asjakahju korral 1,2 miljonilt 1,3 miljonile eurole ja isikukahju korral 5,6 miljonilt 6,45 miljonile eurole. Tehniliste muudatustena sätestatakse ühtne ELi ülene vorm kahjuajaloo tõendamiseks, mis võib olla vajalik juhtudel kui inimene vahetab kindlustusseltsi või elukohariiki ja tahab tõendada oma senist kahjuajalugu. Eestis annab vastavaid kinnitusi välja Eesti Liikluskindlustuse Fond. Eelnõu mõjutab vähem või rohkem nii liikluskindlustust pakkuvaid kindlustusseltse ja kindlustuslepingute vahendajaid; sõidukiomanikke, kes on kohustatud oma vastutuse kindlustama; liiklusõnnetuses kannatanuid ning Eesti Liikluskindlustuse Fondi tegevust. Mõju on seotud näiteks asjaoluga, et tuleb hakata kindlustama ka teatud tüüpi kergliikureid, tõsisemate õnnetuste korral võib avaldada mõju kindlustussummade kasv.
