Summary
Eelnõuga luuakse võimalus sõlmida jaekaubanduses paindlikumaid töölepinguid. Uus regulatsioon tugineb tänavu aprillis sõlmitud Eesti Teenindus- ja Kaubandustöötajate Ametiühingu, Eesti Kaupmeeste Liidu, Eesti Ametiühingute Keskliidu, Eesti Tööandjate Keskliidu ja sotsiaalministeeriumi vahel hea tahte kokkuleppele, millega piloteeritakse jaekaubanduses muutuvtunnikokkulepete kasutamist. Muutuvtunnikokkuleppe järgi võib töötaja lisaks oma tavapärasele tööajale teha täiendavat tööd kuni kaheksa tundi seitsmepäevase ajavahemiku kohta. Sektoris esineb sageli mure, et on tihti vaja muuta töögraafikuid või ajutiselt tõsta töökoormust, mis tingib vajaduse sõlmida ajutise töömahu suurenemisel võlaõiguslikke lepinguid. Eelnõuga luuakse jaekaubandussektori tööandjatele ja töötajatele võimalus sõlmida kindlatel tingimustel muutuvtunnikokkuleppeid, mille sisuks on mõlemale poolele sobiv täiendav fikseeritud minimaalne töökoormus ja paindlik tööajavahemik. Muutuvtunnikokkulepe võimaldab tööandjatel kaasata osaajaga ja paindlikult suuremal määral tööjõudu andes seeläbi tööd rohkematele inimestele ning tagades neile töölepinguga suurema kaitse võrreldes võlaõigusliku lepinguga. Muutuvtunnikokkuleppe võib sõlmida töötajaga, kes töötab osalise tööajaga seitsmepäevase ajavahemiku jooksul 12 tundi või enam ja kelle tunnitasu on vähemalt 1,2-kordne tunnitasu alammäär. Muutuvtunnikokkulepe tuleb sõlmida kirjalikult. Kõik muutuvtunnid, mida tööandja võib uue kokkuleppe raames pakkuda, on vabatahtlikud ja eraldi kokkulepitavad. Eelnõu näeb ette, et tööandja võib muutuvtunnikokkuleppe sõlmida kuni 17,5 protsendiga oma töötajatest, ehk seda võimalust saab kasutada jaekaubanduse tööandja, kellele on vähemalt 6 töötajat. Muutuvtunnikokkulepete regulatsioon on tähtajaline ja kehtib 2,5 aastat. Muudatused on kehtestatud tähtajalisena, sest see võimaldab enne perioodi lõppu selle mõjusid hinnata, mille tulemusel saab otsustada, kas muutuvtunnikokkulepete sõlmimist on otstarbekas pikendada või laiendada ka teistele sektoritele.
