Summary
Eelnõu eesmärk on tagada riigi julgeolek ja välissuhtlemine, kaitstes salastatud teavet avalikuks tuleku ja juurdepääsuõiguseta isikule teatavaks saamise eest. Eelnõuga ajakohastatakse salastatud teabe töötlemise nõudeid, et luua regulatsioon, mis järgiks nüüdisaegse teabehalduse ja paberivaba asjaajamise põhimõtteid ning hõlmaks tänapäevaseid teabe töötlemise viise ja teabekandjaid. Kehtivad salastatud teabe töötlemise nõuded on koostatud eelkõige paberdokumente silmas pidades, mistõttu need ei ole täies ulatuses ja mõistlikult rakendatavad elektrooniliselt töödeldava salastatud teabe korral. Eelnevast lähtudes ajakohastatakse salastatud teabe märgistamise ja hävitamise reegleid, viies viimased vastavusse arhiiviseaduse nõuetega. Vabariigi Valitsuse määruse tasemel reguleeritakse detailsemalt salastatud teabekandjatele salastamismärgete kandmise ning olemikontrolliga seonduv. Eelnõuga laiendatakse teabeloojate otsustuspädevust teabe salastatuse ennetähtaegsel kustutamisel ja salastamistähtaja pikendamisel. Teadmisvajaduse põhimõtet ja otsustusprotsessi tõhusust silmas pidades saavad eelnõu kohaselt julgeolekuasutuse ja Kaitseväe ning jälitusasutuse juht õiguse otsustada enda asutuse loodud riigisaladuse salastatuse ennetähtaegse kustutamise üle. Samadest eesmärkidest lähtuvalt antakse ministeeriumi valitsemisalas loodud teabe salastamistähtaja pikendamise vajaduse üle otsustamise õigus valdkonna eest vastutavale ministrile ning Riigikantselei loodud riigisaladuse puhul riigisekretärile. Julgeolekuasutuste loodud riigisaladuse salastamistähtaja pikendamise otsuse teeb eelnõu kohaselt julgeolekuasutuse juht. Vabariigi Valitsus kollegiaalorganina otsustab jätkuvalt sellise riigisaladuse salastamistähtaja pikendamise üle, mis on kantud Vabariigi Valitsusele või valitsuskomisjonile otsustamiseks esitatud teabekandjale. Eelnõuga muudetakse paindlikumaks ministeeriumi valitsemisalas teenistusvälistele füüsilistele isikutele õiguse andmine juurdepääsuks piiratud taseme riigisaladusele.
