Summary

The bill changes the size of the fine unit, which is the basis for setting a fine, provided in the Penal Code (hereinafter KarS) and doubles it, i.e. from four euros to eight euros. At the same time, the calculation of the amount of the fine will be made more flexible, the restriction will be abolished, according to which a fine of at least three fine units, or 12 euros according to the current rate, can be imposed for a misdemeanor. As a result of the change, a misdemeanor can be determined in the future, the fine for the commission will also be the amount of one fine unit, i.e. eight euros. An exception is created for the treatment of minors, and the calculation of the fines imposed on them must be based on half of the amount of the fine provided by law. If the law prescribes a fine of up to 300 fine units as the maximum permitted punishment, a minor can only be fined up to 150 fine units for the same violation. Fine due to the increase, the misdemeanor procedure code (hereinafter VTMS) will also be amended. The Traffic Act (hereinafter also referred to as LS) stipulates seven euros instead of five euros as the basis for calculating the warning fine for exceeding the permitted driving speed. Due to this change, the maximum warning fine allowed in the written warning procedure will also be increased.
