Summary
Eelnõuga muudetakse karistusseadustikus (edaspidi KarS) sätestatud rahatrahvi määramise aluseks oleva trahviühiku suurust ja tõstetakse see kahekordseks ehk neljalt eurolt kaheksale eurole. Ühtlasi muudetakse rahatrahvi suuruse arvutamine paindlikumaks, kaotatakse ära piirang, mille kohaselt on väärteo eest võimalik määrata rahatrahvi minimaalselt kolm trahviühikut ehk kehtiva määra kohaselt 12 eurot. Muudatuse tulemusena saab määrata väärteo toimepanemise eest rahatrahviks edaspidi ka ühe trahviühiku suuruse summa ehk kaheksa eurot. Alaealiste kohtlemiseks luuakse erand ja nendele määratavate rahatrahvide arvutamisel tuleb lähtuda poolest seaduses sätestatud rahatrahvi suurusest. Kui seadus näeb suurima lubatud karistusena ette rahatrahvi kuni 300 trahviühikut, siis alaealisele on sama rikkumise eest võimalik määrata vaid kuni 150 trahviühiku suurune rahatrahv. Rahatrahvi suurendamise tõttu muudetakse ka väärteomenetluse seadustikku (edaspidi VTMS). Lubatud sõidukiiruse ületamise eest määratava hoiatustrahvi arvutamise aluseks olevaks summaks sätestatakse liiklusseaduses (edaspidi ka LS) senise viie euro asemel seitse eurot. Selle muudatuse tõttu suurendatakse ka kirjalikus hoiatamismenetluses lubatavat maksimaalset hoiatustrahvi.
