Summary
Ekspordi riikliku tagamise seaduse muudatusettepanekud jagunevad kaheks. Enamik muudatusi on vajalikud võimaluse loomiseks anda riiklik eksporditagatis ka selliste lühiajaliste tehingute krediidikindlustuslepingute alusel, milles on määratletud tagatisevõtjast erinev kindlustatud isik. Lisaks muudetakse piirangut samaaegselt kehtivate riiklike eksporditagatise mahule: mahtu suurendatakse seniselt 191 734 949 eurolt 400 000 000 eurole. Eelnõuga kaasneb eelkõige majanduslik mõju, mis seisneb mõjus ettevõtete tegevusele ja ettevõtluskeskkonnale. Kaudselt võib eelnõu avaldada mõju ka regionaalarengule. Seletuskirjas märgitakse, et 2009. aasta lõpus jõustunud ekspordi riikliku tagamise seadus (edaspidi ERTS) sätestab ekspordi riikliku tagamise alused ning määratleb riikliku eksporditagatise andjana riigi poolt asutatud krediidikindlustusseltsi. 2010. aastal alustas ekspordi riikliku tagamise korraldajana tegevust aktsiaselts KredEx Krediidikindlustus. Riikliku eksporditagatise andmine on reguleeritud Euroopa Liidu õigusaktidega, mis seavad piirangud nii lühi- kui pikaajalistest eksporditehingutest ostjatele tulenevate maksekohustuste tagamisele riigi toel, eesmärgiga vältida riikide poolt sellise abi andmist, mis kahjustab või ähvardab kahjustada konkurentsi ega ole seetõttu siseturuga kokkusobiv.
