Summary
Seadust muudetakse, et tõsta liiklusohutust, eelkõige vähemkaitstud liiklejate turvalisust, samuti luuakse selgemad reeglid elektritõukside kasutamisele. Eelnõu kohaselt sätestatakse elektritõukside parkimisreeglid. Tõukerattad tuleb edaspidi parkida paralleelselt kõnnitee ääre juurde võimalusel mitte kaugemale kui 20 cm. Teistele liiklejatele peab läbipääsualaks vabaks jääma vähemalt 1,5 meetri laiune teeosa. Kohalik omavalitsus saab õiguse piirata tõukside liikumiskiirust kohtades, kus see on vajalik, näiteks lasteaedade juures või tiheda liiklusega tänavatel. Ohutuse tõstmiseks tuleb mootorsõidukil hoida ratturist, tõukerattast või pisimopeedijuhist möödumisel 1,5 m laiust külgvahet. Liiklusohutuse tagamiseks kehtestatakse kergliikurijuhile, jalgratturile ja pisimopeedijuhile maksimaalne lubatud alkoholi piirmäär, milleks on 0,5 promilli ehk 0,25 milligrammi alkoholi ühes liitris väljahingatavas õhus. Siiamaani tuli politseil anda kontrollimisel subjektiivne hinnang, kas tegemist on joobeseisundiga või mitte. Selge piirmäär teeb edaspidi lihtsamaks avaliku korra hoidmise ning annab võimaluse ka igaühel endal hinnata oma seisundit. Muudatusi tehakse ka mootorsõidukite peatumisele kõnniteel, tulevikus tohib seda teha ainult lubava liiklusmärgi korral. Seni kehtis põhimõte, et kõnniteel võib kauba laadimiseks peatuda mootorsõidukiga ka juhul, kui selleks ei ole liikluskorralduslikult eeldusi loodud. Vastava liikluskorraldusvahendiga märgistatud kauba laadimise kohad peatumiseks ja parkimiseks saab korraldada kohalik omavalitsus, maa valdaja, ettevõte või näiteks korteriühistu. Parkimisrikkujate mõjutamiseks tõusevad ka peatumise ja parkimise nõuete rikkumisega seotud maksimaalsed trahvimäärad – üldmenetluses 40 eurolt 80 eurole ja kirjalikus hoiatusmenetluses 20 eurolt 40 eurole. Kui rikkumine on ohtlik teistele liiklejatele või häirib oluliselt liiklust, tõuseb lühimenetluses mõjutustrahvi määr 40 eurolt 60 euroni ning kirjalikus hoiatusmenetluses määratakse trahv suurusega 60 eurot. Lisaks tehakse eelnõuga muudatus, millega lõpetatakse automaatse liiklusjärelevalve süsteemi andmekogu ja selle andmed viiakse üle politsei andmekogusse POLIS. Seadus on plaanitud jõustuma üldises korras, välja arvatud muudatused, mis puudutavad mootorsõidukite kõnniteel peatumise keelamist ja 1,5-meetrise külgvahe hoidmist, on plaanitud jõustada alates 2025. aastast. Nii on aega liiklejatel nõuetega kohaneda; samuti jõuavad kohalikud omavalitsused, ettevõtted ja näiteks korterühistud korraldada peatumise kaupade laadimiseks ning riigiasutused vajalikku teavitust teha.
