Summary
2014. aasta kevadel käivitas USA seoses Venemaa agressiooniga Ukrainas operatsiooni Atlantic Resolve, millega suurendati oluliselt USA sõjalist kohalolu kõikides NATO idapoolsetes liikmesriikides, sealhulgas Eestis. Kokkulepe rajaneb ka NATO vägede staatust puudutaval lepingul (NATO SOFA), mis annab õiguse täpsustada seda liikmesriikide kahepoolsete kokkulepetega. 2015. aastal sõlmiti Eesti ja USA vaheline Kaitseväe valduses olevate alade ja ehitiste kasutamise kokkulepe, mis asendatakse nüüd uue ja üksikasjalikumaga. Uues kokkuleppes reguleeritakse USA relvajõudude, nende liikmete ülalpeetavate ja lepinglaste staatust, maksuvabastusi, vara sisse- ja väljavedu, keskkonnakaitset, tolliprotseduure, kriminaaljurisdiktsiooni jagamist Eesti ja USA vahel jpm. Tõhus õiguslik alus loob parimad eeldused USA vägede kohaolekule Eestis. Nii kohaloleku üle otsustajatel kui ka relvajõududel endil on kindlam ja lihtsam saata oma üksusi riiki, kus on toimiv kord praktiliste küsimuste lahendamiseks. Kokkuleppele kirjutasid alla kaitseminister ja USA suursaadik 17. jaanuaril 2017 Tallinnas. Pärast allakirjutamist on vaja kokkulepe Riigikogus ratifitseerida, sest selle rakendamiseks on vaja muuta käibemaksuseadust ja riigikaitseseadust. Kokkulepe jõustub hilisema sellise noodi kuupäeval, millega pooled on saatnud teineteisele teate kokkuleppe jõustumiseks vajaliku riigisisese menetluse lõpetamise kohta. Eestis tähendab menetluse lõpetamine ratifitseerimist.
