Summary
Eelnõu peamine eesmärk on viia riigisisene õigus kooskõlla Euroopa Liidu õigusega ja kehtestada meetmed, millega välditakse ja vähendatakse jäätmete tekitamist ning jäätmete tekitamise ja käitlemise negatiivset keskkonnamõju. Kehtivas jäätmeseaduses ei ole selgelt toodud välja, et toidujäätmete tekke vähendamisel tuleb toidu annetamisel ja muul viisil ümberjaotamisel eelistada, et toit jääb inimestele toiduks, mitte ei saa söödaks ning et seda ei töödelda ümber toiduks mittekasutatavateks toodeteks. Eelnõu täiendab ja täpsustab laiendatud tootjavastutuse regulatsiooni. Eelnõu laiendab ja täpsustab rehvide tootja mõistet, mille tulemusel saab vanarehve anda üle piiramata koguses vanarehvide kogumispunkti ning millega väheneb vanarehvide viimine selleks mitte ettenähtud kohta, nt metsa alla. Eelnõu täpsustab mootorsõiduki tootja, põllumajandusplasti tootja ja mootorsõiduki osa tootja termineid, mis võimaldab õigusselguse huvides ja praktikas ilmnenud probleemide järgselt vähendada päringuid tootja mõiste osas ning mõistega seotud vaidlusi tootjate ja riigiasutuste vahel. Eelnõu eesmärk on tagada probleemtoodete jäätmete kogumise ja ringlussevõtu sihtarvude täitmine korrastades ja sätestades selleks probleemtoodete ja nendest toodetest eraldatud osade kokkuostul senisest konkreetsemad nõuded. Lisaks pikendab eelnõu probleemtootest tekkinud jäätmete tagasivõtmise, kogumise, taaskasutamise ja kõrvaldamise kohustuse rikkumise väärtegude aegumistähtaega, et võimaldada vähendada väärtegude aegumiste osakaalu ning tagada nõutavate sihtarvude täitmine. Eelnõu loob jäätmete ladustamiseks ning ohtlike jäätmete käitlemiseks keskkonnakaitselubade taotlemisel nõutud tagatise osas õigusselguse ja vähendab seeläbi vaidlusi ning taotlejate ja riigiasutuste koormust. Eelnõu annab valdkonna eest vastutavale ministrile õiguse kehtestada määrusega jäätmetest proovivõtu kord ning luua seeläbi paremad võimalused jäätmete usaldusväärseks klassifitseerimiseks. Probleemtoodete kokkuostmise ja vastuvõtmise muudatuste kehtestamine ei muuda jäätmeseaduses kehtivat põhimõtet. Probleemtoodete kokkuostmise piirangu nõudest kaotatakse ära tekstiosa „ohtlike aineid“. Viidatud märge on eksitav, kuna probleemtooted (elektri- ja elektroonikaseadmed, patareid ja akud, romusõidukid), mida müüakse juba sisaldavad ohtlikke osi. Laiendatud tootjavastutuse põhimõtte kohaselt vastutab tootja turule suunatud probleemtoodete jäätmekäitluskohustuste täitmise eest.
