Summary

The main purpose of the bill is to bring national law into line with European Union law and to establish measures to prevent and reduce the generation of waste and the negative environmental impact of waste generation and handling. In the current waste law, it is not clearly stated that in order to reduce the generation of food waste, when donating and redistributing food in other ways, priority must be given to food remaining food for people and not becoming feed, and that it not processed into non-food products. The bill supplements and specifies the regulation of extended producer responsibility. The bill expands and clarifies the concept of a tire manufacturer, as a result of which an unlimited amount of used tires can be handed over to a collection point for used tires, and which reduces the need to take used tires to a place not intended for this purpose, e.g. under the forest. The purpose of the bill is to ensure the fulfillment of the target figures for waste collection and recycling of problem products by organizing and establishing more specific requirements than before for the purchase of problem products and parts separated from these products. In addition, the bill extends the statute of limitations for misdemeanors in violation of the obligation to take back, collect, reuse and dispose of waste generated from problem products, in order to enable the reduction of the proportion of statutes of limitations for misdemeanors and to ensure that the required target numbers are met. The bill creates legal clarity regarding the guarantee required when applying for environmental protection permits for waste storage and handling of hazardous waste, and thereby reduces disputes and the burden on applicants and state authorities. The bill gives the minister responsible for the field the right to establish the waste sampling procedure by regulation and thereby create better opportunities for reliable classification of waste. The introduction of changes to the purchase and acceptance of problem products does not change the principle in the Waste Act. The part of the text "dangerous substances" will be removed from the requirement of the restriction on the purchase of problematic products. The indicated indication is misleading, as problem products (electrical and electronic equipment, batteries and accumulators, scrap vehicles) that are sold already containing hazardous parts. According to the principle of extended producer responsibility, the producer is responsible for fulfilling the waste management obligations of problem products directed to the market.
