Summary
Eelnõuga tõstetakse kohtu, äriregistri, mittetulundusühingute ja sihtasutuste registri ning kommertspandiregistri toimingute riigilõivumäärasid, lihtsustatud menetluste ja maksekäsu kiirmenetluse piirmäära ning piirmäärasid, mis on seotud menetlusosalise edasikaebeõigusega. Lisaks muudetakse menetlusdokumentide kättetoimetamise tingimusi ning maksekäsu kiirmenetlust puudutavaid sätteid. Eelnõuga viiakse kohtusse ja Tartu Maakohtu registriosakonda pöördumisel tasutavad riigilõivumäärad kooskõlla viimastel aastatel muutunud majandusnäitajatega. Enamik eelnõuga muudetavaid riigilõivumäärasid kehtib muutumatult juba üle 10 aasta, s.o. alates 1. jaanuarist 2011. Seletuskirjas märgitakse, et kohtu lõivumäärade tõstmine on vajalik, et ajakohastada kohtu toimingutega seotud riigilõive selliselt, et eelnõuga kehtestatavad riigilõivumäärad kataksid osaliselt kohtu tegevuskulude kasvu ning välistaksid pahatahtlikud või ilmselgelt perspektiivitud kohtusse pöördumised ning suunaksid vaidluse osapooli otsima kohtuväliseid lahendusi. Registriosakonna toimingute lõivumäärade tõstmine on samuti vajalik, et ajakohastada toimingutega seotud riigilõive ja et eelnõuga kehtestatavad riigilõivumäärad kataksid osaliselt registriosakonna tegevuskulude kasvu, mille järel on võimalik pakkuda paremat teenust ning tagada registris olevate andmete õiguskindlus. Äriregistris olevate ettevõtete arv on aastatega kasvanud, mistõttu on suurenenud ka infosüsteemide haldamise kulud. Järgnevatel aastatel on kavas veelgi arendada äriregistri infosüsteeme, et muuta süsteem kasutajasõbralikumaks ja automatiseerida eri infoväljade täitmine. Näiteks 2021. aastal valmib Registrite ja Infosüsteemide Keskusel uus äriregistri portaal, mis koondab kodanike ja ettevõtjate jaoks ühte keskkonda nii teabesüsteemi kui ettevõtjaportaali võimalused. Kohtuametnike hinnangul ei ole kohtusse pöördumine sageli enam viimaseks ja kaalutletud variandiks, vaid kohtusse esitatakse avaldusi teise poolega eelnevaid läbirääkimisi pidamata ja menetluse perspektiivikust kaalumata, kuna kohtuskäimine on inflatsiooni ja elatustaseme tõusu tõttu teiste teenustega võrreldes odavnenud. Eestis on ettevõtte asutamine võrreldes ülejäänud maailmaga väga lihtne, kuid kandeavaldusi esitatakse puudustega ning avalduste kontrollimine ja puuduste kõrvaldamine toob kaasa osakonna töökoormuse kasvu. Arvestades muutunud majandusnäitajaid, on riigilõivumäärade mõistlikus ulatuses tõstmisega võimalik tagada menetlusökonoomiat, ohustamata isikute ettevõtlusvabadust ning ülemääraselt riivamata igaühe põhiõigust pöörduda kohtusse.
