Summary
Eelnõuga luuakse lahendus, mis võimaldab rakendada ELi grupierandeid ka riigisiseses konkurentsiõiguses. Grupierandid on üks enim kasutatavaid ELi konkurentsiõiguse töövahendeid. Grupieranditega on hõlmatud suur hulk kaubandustegevuses laialt levinud lepingutüüpe, millel hoolimata konkurentsi kahjustavate sätete olemasolust on positiivne mõju tarbijatele ja majandusele. Grupierandeid töötab välja ja kehtestab ELi tasemel Euroopa Komisjon ning nad kohalduvad Eesti ettevõtjate suhtes siis, kui nende kokkulepped omavad mõju liikmesriikide vahelisele kaubandusele. Pakutava lahenduse puhul on tegemist nö hübriidlahendusega, kus ühest küljest muutuvad ELi grupierandid riigisiseses konkurentsiõiguses sisuliselt vahetult kohaldatavaks, kuid teisest küljest on riigisiseselt siiski jäetud võimalus need grupierandid eelnevalt üle vaadata ja anda ministri määrusega kinnitus, et need grupierandid on Eesti õiguskorrale tõepoolest sobivad ja vajalikud. Samuti on jäetud võimalus kehtestada vajadusel ka riigisiseseid grupierandeid. Viimast on võimalik teha valitsuse määrusega. Pakutav lahendus võimaldab tagada õiguskindluse ja tõhusa konkurentsijärelevalve, vähendades samal ajal haldus- ja bürokraatlikku koormust. Samuti aitab see suurendada ettevõtjate õiguskindlust ja hoida kokku õigusnõustamisega seotud kulusid. Täiendatud regulatsioon ei mõjuta praegust konkurentsiolukorda. Eestis kehtib praegu üks valitsuse määrusega kehtestatud vertikaalseid kokkuleppeid puudutav grupierand. Muudatuse tulemusena hakkab Eestis kehtima kokku kuus grupierandit, millest kaks: raudtee-, maantee- ja siseveetranspordi ning tehnosiirde kokkuleppeid puudutavad grupierandid, ei olnud seni Eesti õigusesse üle võetud. Seadus on planeeritud jõustuma üldises korras.
